    ZTD perhaps I didn't make it clear earlier(sorry if I didn't) but the solicitors I have are from my legal cover and are are also no win no fee... but still can only claim the write off cost for my car...my problem is that the LAW allows people like me through no fault of their own should be in a significantly worse position when their car is wrote off by a driver that was driving without due care and attention...the other side are taking full responsibility.the girl never gave way at a junction and failed to stop.
    Depreciation should not come into it as far as I'm concerned as I was not selling the car anyway.I bought a good vehicle brand new 10 months ago so that we and our passengers could travel in total safety and both myself and DH are very careful drivers.I have never had a accident whilst driving ever and DH in 27 years driving a taxi has had 3(including this one) two he was hit from behind and this one.I believe there should be a law whereas you are in exactly the same position you were before the accident in a no fault accident.I am going to look into this and maybe get a paper etc involved...solicitors just agree that it is unfair!!!!
    I amsick of criminals getting better treatment than the hard working ordinary folk in this country.

    I can only add to what has been said, which is that i hope you know i am thinking about you, and i would definately lobby everyone you can think of.
    I totally agree with your thinking, re fault and being left out of pocket...as to the other i qould hope you have calmed down a bit and perhaps visit GP, a lot of it is frustration and anger..and you internalise it because you cannot vent it on the person who deserves it!

    so as everyone says..come on here and hit as many keys as you can, invent new ways to get around the swear filter..even.

    Morning all...haven't been to work today as woke with a banging head.I have to be out at 1pm as I have that second driving test..just what I need!!!!!...then that's the exam complete...I've passed anyway...DH has his final one at 4pm.
    I have been quite productive today (I think)....I phoned the solicitors...the salvage value( £1500) is paid direct to me by the salvage yard and the other £6300 paid direct to me from the solicitors....so I then have to wait for cheques to clear before I can pay GMAC their finance....when these cheques arrive I only have the hire car for 7 days as they don't get paid for that it's a curtesy thing....
    It takes 10-14 days(if in stock) to get a brand new car from vauxhall and the I've to pit it etc etc...so this would have meant more loss of earnings!!!!

    So I phoned GMAC to see if it's possible to have a loan at the same time with them for a new car and settle the other one when the money comes through...or should I get a bank loan....he was clueless and said he didn't do bank loans.....aahhhhhhhh!!!!!!! then put the phone down on me.
    So I phoned my dealership and spoke to the finance guy there and he is certain he can sort it.They have 20 cars in stock in the right colour and it will take 10-14 days to get me one.He said he can put notes on the file to say that £8300 of the £9178.51 will be cleared and add the remainder to the finance.The new car prices are out today so he can't give me the exact details until 1pm as they are all in a meeting until then.So I've asked if he can phone me after 2.30pm.So fingers crossed he can sort me my new car out..while we sort this mess out.
    The hire firm have also spoke to me and they are sending someone down to the write off car to take out the radio system and they are paying it and recovering the money so that's another £150 I don't have to pay..it then has to be tested for damage..but we'll cross that bridge when we come to it.
    Think that's it for now and will keep you all updated.

  • Well i am glad things are moving, little steps all forward..as for GMAC, i am not their biggest fan..they were very pushy a couple of years ago when we were enquiring about a mortgage, as MR.b, was self employed at the time, constantly rang, tried to intsigate solicitors etc, after we had arranged a valuation...I just felt harried by them, as they wanted to complete in a month..too quick for me as i needed time to think,,etc. Anyway we stuck with NR, who were offering a better rate. And far less hassle at the time, although bad news now..gulp!

  • Sorry to hear about how it panned out. I had a funny feeling it would have worked against you. Hopefully the medical claim will minimise the shortfall. If the motor is wrote off you are always going to struggle with the depreciation.

    As I have said before the main thing is your oh is ok.

    Thanks all.Next update my new car has been ordered.The salesman at Vauxhall has sorted the finance so that I can set up the new one separately from the old one...the only problem this causes is that I will have to pay two car finance plans until the cheque comes through.It will be a bit of a struggle but is swings and roundabouts IYSWIM...
    He has ordered it for me already and I have to pop in with a deposit for £250 in the morning and sign the paperwork so I have got the ball rolling.I only have a week on the hire car when the insurance send the cheque so am trying to minmise the time that I will be off the road.10-14 days for delivery of the car and then I need to have the radio equipment fitted etc and pit the vehicle..so thats at least a 3 week turnover....my other radio out of the write off has been returned to the office and is awaiting testing so fingers crossed that one is ok....not a lot else to report as not a lot else going on here at the moment.We are on our day off tomorrow so will drop the deposit off at Vauxhall and buy the necessities only when going shopping and that's about it really as I really need to chill out.
