Private parking ticket gone to court - Help Needed!

Le_Kirk said:hilly2020 said:They are: Parking Control Management (UK) Ltd with Gladstones acting as their representatives.
I got a copy of the claimants witness statement.
I have 1 case to defend.
My thrust is: their witness statement is for a separate ticket and not the ticket in question. Also I had a parking permit at the time of the ticket.
Yes they added the extra fees.
I have read a few posts and find them helpful. I had started writing my defence using templates but wanted to make sure i'm saying the right things, hence the reason for a new post.

By when do you have to submit your defence? Do you have to submit your WS at the same time? Have you a date for the new hearing?
So I am assuming I submit my defence 10 days before my hearing date again?!
Ill upload my defence letter as soon as I complete it, really appreciate everyones help!1 -
So I am assuming I submit my defence 10 days before my hearing date again?!Please don't assume that. Please don't assume anything.
You must find out exactly what the Court Order tells you to do, and what dates you need to do it by.4 -

They're in the wrong as I had a parking permit at the time (but not on display) and in their WS, when they mention "Defendant's Defence" its about a different parking ticket I got from them 2 months after.
I have attached it as reference but hope this makes sense?!0 -

This is the last letter I received from the court2 -
But what does the court order tell you to do?2

Ah so you haven't had a more up to date order - so what makes you believe you must do something, and what is that something? What I mean is, if you had a hearing and a Judge said it was adjourned for a party to do x and y, then an Order will come out in the post confirming the Judge's directions for x and y.
So we want to know, did your Judge say you have until x date to file and serve an amended DEFENCE or to file & serve an amended WITNESS STATEMENT AND EVIDENCE? These are two different things. What did the Judge say?
Also, what you mean is, YOU were in the wrong for putting stuff about the wrong PCN in your defence. All they've done is quote your defence. You talked about the wrong PCN because the claim didn't make it clear?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The judge adjourned the case as the claimant didn't send me their witness statement and evidence in the post.
The judge said to me to get advice on how to present my defence in court as I turned up with no idea.
There is no set date for the adjourned case because of covid.
Yes I was in the wrong for turning up to court with the wrong defence, however the claimant got the cases mixed up as well in their witness statement and evidence.
Quote:
"17. The Defendant states that on the said date in question, "a large white van" was blocking any signage. The Defendant also avers that upon receipt of the charge, he appealed the matter to no response. It is the Defendant's case that owing to the above, the PCN is "unjustified"."
I never mention anything about "a large white van" in my defence statement to the parking company, this was for a separate ticket altogether.
Hope i've used the correct lingo and that makes a bit more sense2 -
OK. What exactly did your defence say? Word for word please.
We need to see what we can build on for your WS.
And do you have to do something yet? Did the Judge require that you now file & serve a better defence before anything else happens?
Or are you awaiting a court date and must then do the usual WS & evidence that it seems you didn't do at all?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
