Parking Fine - ParkingEye - After having to wait 3 hours in a Queue.

I have read the Beginners thread, however, these circumstances are a little different.
On the15th of June, I went shopping at Belvedere Kingston Park Retail Park. Understandably, with Sports Direct having 50% off for NHS workers on their 1st day of opening after lockdown... It was extremely busy! 

To begin with, there was over a 2-hour wait to get into the Sports Direct. We shopped for an hour and most of that was waiting in a small queue for staff to get the correct shoe sizes and then there was over an hour wait at the tills. Totalling my time spent parked their 4h30

I've just received a fine through the post for £70. I can't imagine that I've been the only one.

You would have thought that the private parking firm would have expected this and had discussions with the retail park management prior to the shops opening... I'm trying to ring Sports Direct, to no avail and I'm struggling to find a contact number for the retail park management.

If not, which template would be best to send as a letter of appeal?

    First job is a retailer or landowner cancellation , no question , no it's or buts , that is your priority , but it will be the retail park management company or the landowner , not sports direct

    If the vehicle is registered in your name , then use the blue text template unchanged and appeal as keeper on the pe website

    No blabbing about who was driving

    And check if you have a golden ticket or not ? Does the PCN comply with POFA ? Or not ?

    Do the above in that order , especially if this happened in England

    There's only one - it's in blue coloured text.

    Try a letter to Mike Ashley!  For the retail park managing agent, try contacting other retailers there to ask if they know who it is.

    A Google search says this is Newcastle , so in England

    It also mentions Wilkinson Williams , plus a local paper names Universities Superannuation Scheme Ltd (USS), the UK pension scheme as the owner

    Always try Google search , especially at a multi outlet retail park

    Thanks for such speedy responses! I did come across USS, but got a little confused with it being a Pension Scheme.  I'll get onto them now and keep thread updated, as I'm pretty positive I won't be the only one .

    The Barry Beavis case centred on land owned by the British Airways pension scheme , many schemes invest money into land , buildings etc as well as stocks & shares or gold. It is never a surprise to find land or buildings are owned by a pension scheme

    You left out your findings from your initial post , but I soon found it

    As Redx says,  find out who the landowner is and get it cancelled

    You are right about these parking companies. They are only interested in money and Parking Eye should be acting in a more responsible manner due to social distancing. Apart from the above, appeal to PE stating your were obeying government instructions for social distancing, see what excuse they come back with.

    We will see a lot of this but would a judge condone it when the public are obeying the government ?

    I got in touch with Universities Superannuation Scheme Ltd (USS). got passed pillar to post, but eventually got someone a little helpful, and she gave me an email address. Will wait to hear back from them and keep thread updated

    If it comes back no , then take it to the local/national press and name every one who has not helped.

    Tell the local sports direct manager and head office CEO that you wish to return everything as you did not realise that the price included a £70 surcharge

    PE's sign are not up to snuff, many judges will dismiss court claims because of this, read this,

    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation. 

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up,

    Just as the clampers were finally closed down, so hopefully will many DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
