Precisely
and this fits into the pre-action protocols how exactly?
How is that my concern? What have PAPs got to do with it?0 -

How is that my concern? What have PAPs got to do with it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

And here. boys and girls, is a little bit of advice to retail park owners from yer old pal MothballsWallet:
In the current situation, with government guidance (and laws) on social distancing to control the spread of a contagious virus, instruct your PPC agents to use their common sense (I know that is rare in PPC world) and that people will take longer to shop due to the distance restraints and reduced staff numbers in a lot of shops.
Of course, it could be argued that PPC staff aren't essential/key workers at this time....6 -

Keep your eye on the ball, and make sure you get a formal, written cancellation notice from ParkingEye. They usually do, but in case it falls through the cracks and PE escalate it, also keep that reply!DAP313 said:Thank you all for your help, for it cancelled.
Here's the reply I got;...
I have contacted Parking Eye to arrange for this PCN to be cancelled and we will confirm once this has been completed. In the meantime we will also look to review the parking restrictions on the park in light of the current situation.
PE had a perfectly legitimate reason for obtaining the keeper's details in this case. The car was parked in excess of the stated period. They weren't to know the mitigating circumstances that ultimately led to cancellation.D_P_Dance said:Now consider sending the PPC an LBC.

I disagree,. PE should have been aware of the long waits to shop. due to the social distancing meadsure in place. In fact, they should have ceased issujng tickets in this car park. The ticket was therefore imo issued without due cause.
I suspect that some judges would agree with me, some with you. My post therefore was perfectly valid. You never know how far you can go until you go too far.1
