    Right so is there any other grounds i can contest on... or to at least get a reduced fine from it
    The picture they have sent only shows the car on the road not anywhere near the shopping centre 
    i haven't communicated with them to even confirm who the driver was...

    On the first initial PCN POFA 2012 is not mentioned.. is this the golden ticket? although when they sent the "letter before country court claim" there is a mention of POFA 2012 so i am not too sure how to treat this
    Also i am contious that the deadline for this is 20th july when do you recommend this gets submitted by?

    You have to check the wording on the PCN (both sides) against the PoFA 2012 (ask Auntie Google) to see if they have complied - in full - to see if they can hold the keeper liable, always providing, of course, you have not blabbed about who was driving.  Most definitely don't confirm who the driver was.

    If the driver has not been revealed the the first post needs editing because the claimant has no idea who was driving , hence the questions about POFA

    The Keeper received an ntk PCN plus a reminder PCN

    The Keeper received an LBC

    The Keeper received the court claim and is currently defending as a Keeper , mainly based on POFA exemption as Keeper and on signage and no landowner authority

    There is no abuse of process because parking eye do not add on spurious charges such as debt collector fees

    The time to pay less was within 14 days of the initial PCN being received , typically £60

    A typical loss in court is £175 when it's a Parking Eye case

    If you are at LBCCC stage with PE, think of it as an appeal stage for the keeper and question 'keeper liability - their POFA reference' and ask for a POPLA code.

    Also up the ante of complaint to the retail park, asap, to nip this in the bud.  PE cancel shedloads at LBCCC stage and they also issue POPLA codes if you email:

    What will the POPLA code prove? and what information do i need to provide when asking for one please?

    Complained to the retail park and the manager has said they cannot intervene at this stage as its too late....
    if i'm honest this is looking like it will be a loss i might just have to pay to avoid risking my credit score

    Well only if i don't submit a defence but by the looks of things i don't really have a leg to stand on here...

    Even if you don't file a Defence, it doesn't mean you credit score is affected.

    To have any affect on your ability to get credit, you have to first lose a court case, and then fail to make the payment ordered by the judge within the timescale allowed.

    In other words, even if you lose a court case, as long as you then pay up promptly, you credit score remains good.

    So at this stage you have absolutely nothing to lose by following the process to defeat these... I'm looking for the right word.  ;)
