This OP is someone I was already in email contact with but due to the gap in time, I didn't twig this when I replied before!

  • Today was meant to be the day of the hearing via video link.
Emailed the court yesterday to say they haven't sent the appropriate link to be able to join a video call, was told this goes at 2pm the day before. Nothing received and a phone call to the court this morning asking what's going on, and it turns out Gladstones emailed the court a week ago to discontinue, but didn't bother their !!!!!! to tell me.

Anyway, it's done and over. Many thanks to all those who replied, in particular, Coupon-mad, without whom the outcome may have been very different.

Now would be a good time to seek your revenge, read this and complain to the court and your MP.

You could try an email to ask the Judge to award your costs (day off work?) for unreasonable conduct, like here:

Residential PCN (initially lost at POPLA)
Premier Park Ltd ordered to pay £500 in costs for unreasonable late discontinuance at Southampton County Court (includes all orders and judgment transcript following his application for a costs hearing:  Premier Park v S Jones):

    https://forums.moneysavingexpert.com/discussion/6271727/residential-pcn-premier-park-ltd-ordered-to-pay-500-in-costs-at-southampton-county-court

The letter to the Judge asking for costs is interesting; it was treated as an 'application' by the Court:

The OP of that case said:
"The 05 Witness Statement is interesting and quotes a post from this forum. The statement by Mr Byers-Nolan was riddled with errors and inconsistencies, ignored the main points of the case and was delivered so late that the Judge ignored it. As he did with my skeleton argument…

You might think I would be steaming with anger with PP, BW Legal, DRP, Gladstones, CST Law, Zenith Collections et al, but no. If POPLA are going to boast on their website that they take “into consideration the relevant law, guidance and standards and the BPA Code of Practice.” they should do exactly that. Don’t employ someone with experience of “conflict resolution” and “problem solving” to decide on points of law. How about employing someone with a legal background to decide on legal matters? The new Government CoP will hopefully remove POPLA from the equation.

And finally, for the Premier Park Ltd and BW Legal employees who lurk on this forum: we still have a BIG problem with the other 24 PCNs you plastered my vehicles with, don’t we?"

    Hello everyone, sadly, I'm back.

Brief recap of the past seven pages is this - I received 4 tickets from PCM and then Gladstones started a MCO for 2 of the tickets, and just as that was coming to court , they started a separate claim for the other 2.
They emailed me to say they were dropping the 2nd claim after letting it run for a time and proceeded with the first to the point where i was home waiting for the video link on the day of the court hearing, only to find Gladstones wrote to the court and dropped the case a week previous, but didn't bother to tell me - real professional company they are.

Now back to current events. Back in February I got another ticket for parking in a bay in the courtyard area of the housing development where I live.
I guess the question i'm wondering is if the pervious cases have any relevance and should be included in the defence of this claim. Given it's a new ticket and new claim, and despite it being an identical claim as the previous 2 dropped cases,  I'm guessing the law views this as perfectly claimable on their part ?
    Thanks for any advice.
