  • Got another ' letter before claim' today from Gladstones . The claim for this thread relates to two tickets, the letter today relates to two other tickets. All four were the same thing other a few weeks. 
    Can they start another small claims case for different tickets but essentially the same thing ?
    On the current claim, what should I expect from them to submit to me before the 14 day limit , and if they fail or do so late, what are the consequences of that ?

    They have a duty to the court to bring all their claims at the same time.  Search for a post by @Coupon-mad where she explains how you go about consolidation of claims.
    You should expect their witness statement and evidence.  If you do not get it, you can ask the judge to give them no relief from sanctions and for the WS and evidence to be struck out and, if they have no evidence, for the whole claim to be struck out.  Be aware though that judges (reported on here) have sided with claimants and not bothered one iota about late WS.

    You need to deal with this LBC afresh. Once a formal claim is raised, at every opportunity, you draw reference to all the cases and require them all to be consolidated to one single case. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes and no.   This has been dealt with HUNDREDS of times on this forum.

    Please search the forum for 'Two claims? consolidate' or 'Henderson v Henderson'.

    Thread bump time. The hearing got cancelled, and now been transferred to another court for 22nd of this month. Only found this out on Friday as been working away. Just as an extra bonus , also received  new paperwork for a second new claim for two other tickets 
    I've had a letter from the court with a general order and the question is about the first point in that letter which says - The parties shall seek to agree a paginated, indexed and tabbed electronic bundle which contains the essential
    documents in the case.
     If the applicant is responsible for putting together a bundle and filing it, is there any onus on them to contact me and what if they don't but submit a bundle, any relevance ?

    You make no mention of when and what you filed & served by way of your WS & evidence.  PLease show us what you submitted last time (not the defence).

    Also do you mean you have another claim form?  We told you how to stop that at LBC stage, did you do this?

    Coupon had the WS and details, just needed a reminder due to the delay.

    As for the court order letter saying  "The parties shall seek to agree a paginated, indexed and tabbed electronic bundle which contains the essential documents in the case." does this mean anything much ? Should Gladstones contact me as they've been ordered to submit a bundle , and are they obliged to send me a copy of the bundle ?
    The previous order for them to create a bundle of a limited number of pages ( I forget how long ) , would mean them shortening one or both WS to comply, which is what I guess they mean by agreeing a bundle ?

    Yes, it means you are required to agree.
    You can either wait for them, and if nothing happens explain that you sat there and did nothing, or you can be proactive. Personally I would do the latter. 
    Everything sent to couirt must be copied to you, and vice versa, so you also obviously check what they send matches in every way wha tyou sent them. 
    No, agreeing a bundle means agreeing what should be included
