  • Don't say: '16 The driver did not acknowledge the signage' !

And this is the wrong statement of truth (Google the new April 2020 version but it IS already in the NEWBIES thred stated very clearly not to use this old statement):
I believe that the facts stated in this Witness Statement are true

If the NtK was from a couple of years ago, it may not have been compliant then (unless we see it, we can't be sure). Have you sent them a SAR?  That will dig it out. So meantime, work on the basis that it wasn't compliant and argue no keeper liability, it won't be fatal to your position even if they did comply. See if you can get the SAR response In sufficient time, but they do have 30 days by law to respond; but note that they won't be marching to the beat of your own drum.
Thanks, I have just sent them an SAR. I think ill be lucky to receive it in time, time will tell i guess.
I finally received the SAR! Too late to be of use and not sure if youre interested but ive uploaded it FYA.
Interestingly on the same day another letter from BW Legal offering 40% discount on the balance of £274.92 if paid before 11th July! The hearing scheduled for the 16th so ill let you know the outcome. Thanks.

You've left the VRM and the PCN reference showing.

Good confirmation that teh NtK doesnt  comply with POFA2012. Warning of liability gives the wrong period.
  • Just had the ruling through. Unforunately i lost and ordered to pay £100 plus interest and costs so total £205.23.
Probably my fault for not seeking advice sooner, lesson learnt.
Judge said signs were clear and state the terms and that I was free to leave within the grace period!
    Thanks anyway.

Sorry for the loss. Was this a face-to-face, video link, telephone, or simply an 'on the papers' only hearing?  How did the costs awarded over the £100 PCN break down please?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is what we call Judge bingo.  Keep an eye on this forum about BWLegal, you will see a lot more court spankings that as yet, they know nothing about

Given the way the op,delivered it,I'm guessing this was papers
a big mistake. No doubt the ppc sent w "plan" of signs, a mock-up and the op couldn't challenge it.
