Victory day!!!!!
I won
Case dismissed on the grounds of inadequate signage not being legible and something about the wording on the PCN not matching what was stippulated on the sign about parking within a bay.
also judge accepted that the car was parked like it was due to a van straddling the lines, but that the way the car was parked to not cause anyone else to be unable to park next to it so there was no loss of revenue or effect on anyone else.
She also noted that she would have considered the abuse of process but that as she was dismissing the case because of the above there was no need.
Claimants scamlicitor asked to appeal and was denied!
Although the judge asked on what grounds so she could fill forms out, not sure if thats so they can appeal or not? so not sure what is happening with that I probably should have asked to clarify that but didnt get chance, I did ask for costs and was awarded standard half day witness costs of £42.50
all in all a good day and very happy with the result.
I would just like to say a massive thank you to everyone on here who has given me help and advice over the last 18 months with special mention to coupon mad, fruitcake, Red x and snakes belly all been super helpful so thank you11 -

Peanuts, read this

You never know how far you can go until you go too far.2 -
I did ask the judge to consider that the claimant had been unreasonable but she held the view that they had not and therefore and claim for costs is limited on the small claims track, no idea but ill take the 42.40 and add it to the other 42.50 i was awarded last year when they turned up unprepared6

Half a day is 50% of £95 = £47.50, not £42.50.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.5 -
Give the number of exclamation marks in your edited title, I guess you are somewhat pleased! Well Done.4

also judge accepted that the car was parked like it was due to a van straddling the lines,Even in the ParkingEye v Barry Beavis case, The Supreme Court Lords were suggesting that this was not a contravention, that there were mitigating circumstances, the problem being caused by a third party.Anyway ...... very well done on your win. Good to hear your positive and encouraging news. 🥂
ANOTHER VCS ONE BITES THE DUST!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Congratulations on your win.
Without reading through your entire thread - Gladstones were mentioned at the very beginning - were they the legal reps for VCS all the way through and the ones you defeated today?
If so, then especially well done - true money saving & depriving them (Gladstones) of their ill gotten gains - no contribution from you then towards their £30,000 of SDT fines & costs!!7
