This looks very much like Ultra Vires (acting outside of their powers) because the director had not been appointed at the time of the signing of the contract. This would have made the contract invalid and void. He would not have been able to enter into any finance agreement on behalf of the company until appointed as a director.
Yes this is my best point of defence I think this is the point I was putting across when the solicitor piped up and said I don't have a copy of the WS to which you are refering
I will be pushing this point home hard when the case resumes!
No valid contract no authority to issue PCN! this could open up a huge can of worms for everyone in the village that has recieved a PCN from them during this time!

And can I just add a huge thankyou to you all for invaluable help and support so far! it has been very much appreciated

No worries, this is what we do in our spare time and we are making a difference.

Now there is an important task to do in August:

The final Government Consultation into the level of parking charges, discounts, false ‘debt recovery add-ons’ (that no PPC actually pays)...

...and the Appeals Charter - that should IMHO result in full cancellations not enrich the PPCs by £20 or more because it would just encourage spurious PCNs that should never be issued...

    ... is now open!

    See separate thread:

    https://forums.moneysavingexpert.com/discussion/6286801/government-consultation-re-level-of-private-parking-charges-now-open

This forum’s regulars are encouraging email submissions with evidence and photos, letters attached to illustrate what happened to you and why you are answering the way you are.

Please tell your family and friends to encourage colleagues who have had these spurious PCNs and claims to email their evidence to the MHCLG as shown in the Consultation and not just do the tick boxes.

The Government want evidence - victims must give it to them.  DON’T MISS IT.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

this is the sign they say is acceptable mounted on a post 8 to 10 feet high
    Wait, what??!!

That sign is way too high - you could only read that, imo, seated on a coach or in the cab of an articulated lorry.

According to a Google search, the average heights for people in the UK are 5 feet 9 inches (175.26 cm) for men and 5 feet 3 inches (160.02 cm) for women.

Edit: oops! Looks like I may have been too late as I was only just reading through today.

You're on the wrong forum buddy! 🍖
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
