It has been a while but I have just received a letter of claim from BW legal stating that they have been instructed to bring legal proceedings against me.I honestly thought this had gone away! The estimated claim is as follows-
principal debt + debt recovery costs £160
estimated interest £12.80
estimated court fees £25
estimated solicitors fees £50
estimated total £247.50
I didn’t hear anything back from my MP since contact back in September and don’t know what to do next. If anyone can please help it would be appreciated please.0 -

I have no idea why you thought it had gone away !! The claimant PPC has 6 years to issue a court claim from the CCBC in Northampton ! The lack of income due to the pandemic has accelerated the process of chasing alleged debts
Do you have an LBC or a claim pack from the CCBC in Northampton ?
If it's the latter , post the issue date below
If it's an LBC letter with 30 days notice , follow the LBC and SAR advice in the newbies FAQ sticky thread near the top of the forum , second post

I have received the paperwork through from PCL with all the data they are holding and will wait for what is to come next.If I were to name the driver at this stage would they then issue the driver a PCN for the original amount ?0

If you do name the driver , give name and a suitable address for service of papers and state you are doing so to comply with POFA , making it known why you are doing so and under which law , so are discharging your duty as a keeper
Keep a paper record of naming the driver , in case they still chase you or take it to court , evidence is required , as paper trail
Once a court claim is started , it's too late to name the driver2 -

The standard is SERVICEABLE address
If the driver happens to live overseas, that addres sis serviceable. The PPC will not like it, of course.2
