if you live in london and own a diesel you have been affected by the diesel scandal .. you have to pay the ULEZ pay extra for parking and your car resale value has plummeted
The attack on diesel drivers came after the VW dieselgate scandal
it is an interesting point that if it can be proven that the cars would have passed UK regs with or without the software .. why would the lawyers chase this ?
but it is clearly wrong to suggest that diesel cars owners have not suffered financial damage compared to owners of petrol cars

Awareness of the urban effects of diesel NOx emissions came well before the 2015 "revelations" about VW USA's woes.
Euro3, compulsory for all new cars from 2000, brought in a NOx cap for diesels - 0.5g/km.
Euro4 (2005) halved it, Euro 5 (2009) took it down to 0.18g, then Euro6 (2014) brought it down to the current 0.08g.
ULEZ applies to Euro6 diesels and Euro4 petrols, because the cap is the same for the two standards.
NOx levels were of active concern in London at least as far back as 2011, with "diesel cars" being pointed at as the main contributory factor.

NOx emissions had actually risen as diesel burn got hotter to combat particulates, one of those unintended consequences. You put the same amount of the same chemical compounds in, you get the same things out, just in different combinations.
