Point of note, i searched for the term " wholly unacceptable" in the judgement. I couldnt find it, but did find "I find this signage to be completely inadequate" and a "huge amount of words" if quoting.Coupon-mad said:Do a witness statement* that says why you only put the words you did...i.e. because you know nothing about this alleged contractual breach and the Claimant has provided you only with (what?...spell out how little you know) but you now realise that what was intended as a request for further and better particulars has in fact bound you to that as your defence. Say that you are a litigant in person who knew nothing about the court process and feels ambushed, but that you have much more that you intend to address. There is good reason to allow the defence to be amended, not least due to the clear abuse of process of the parking firm adding £60 to a parking charge, which is double recovery, and due to the parking firm's hundreds of small print wording on their standard small signs having been described by a Judge at Lewes only last month as 'wholly unacceptable' and inadquate to bind anyone to a parking contract.
* with the statement of truth as shown in the NEWBIES thread, above your signature & date. A proper Witness Statement as per all the examples here.1 -
But were you in the courtroom to hear what the judge actually said?Scrapit said:Point of note, i searched for the term " wholly unacceptable" in the judgement. I couldnt find it, but did find "I find this signage to be completely inadequate" and a "huge amount of words" if quoting.3 -
Yeah, but i didnt listen at that point to be honest. Are you suggesting im incorrect in asuming that when quoting it would be best to have quotes which can be evidenced? If so say so for clarity.KeithP said:

Whereas the poster that quoted the term 'wholly unacceptable' was there and was listening.4 -
So? The question remains. And referring to what somebody heard doesnt carry much weight in my opinion. Isnt giving the decision from the judge and using the judges words better than trying to get a court record?KeithP said:
