They could present the pictures and.... ntohing.
They cant adduce them as evidence of anyone iun particular. They cant require you to identify theperson in them, becaue theyre not good enough (they wont be, they cant be, what you see in NCIS isnt posssible in real life) and they done meet ANY evidential standard as regards IDing a living person.
Youre worried over nothing. Theyre liars. Remember, they will lie to you.4 -
As a slight aside, OP, I've always thought that NCIS, CSI, etc., always ramped up their tech ability to basically scare people away from committing crimes because they'd think "I'll get caught because the police lab have all this advanced tech".3

nataliek5 said:Redx said:if they had these human pictures they should disclose them in the SAR as your right under the old DPA which is now the GDPRas a data controller they have to provide you with all your data about you and your vehicle when you do the SAR, plus when they provide their exhibits to you and to the court , in the build up to the actual court caseif they ran a database check on those pictures , they should disclose itas Umkomaas says , ask for those pics in your SAR , put johnny on the spot
To be honest I'm terrified of going to court regardless of whether I win or lose..... I know it's unlikely but there's still a very slim chance
What if they show the images in court and it turns out to be someone I know? Or the judge thinks it looks like me? I'd lose the case then wouldn't I? Would court fees then be added to the total amount owed??
They cannot just rock up in court with undisclosed evidence , an ambush , the evidence presented would normally be inadmissible
The court is only there to decide who owes who and how much , the judge is the referee
They won't put you in prison , they won't confiscate your pet , they won't put you in the stocks and they won't bring back hanging
I would be more worried about a shoplifting charge or actual bodily harm as a court case , than a dispute over a few hundred pounds , I don't remember anyone on Judge Rinder having to encounter Madame le guillotine
On a side note , Xand Van Tullekan looks exactly like his twin brother Chris , spooky or what ?3 -
Thanks all. You guys have made me laugh as well as assure me there is nothing to worry about.
I have asked PWE to provide the "enhanced images" so that I can "assist them in identifying the driver". Lol.
I have also asked them to stop equita from contacting me until they can prove that I am liable. Not sure what will happen there but I guess I can only ask.
I will try to write a SAR request.... hoping to find a template somewhere - I will search the forum and update you all if I hear anything further.
Thanks2 -

https://legalbeagles.info/library/guides_and_letters/court/subject-access-request/Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Include these enhanced images into that SAR request as a specific item , plus all your data including pictures , documents etc , I do not believe that any reasonable enhanced images will arrive , just the usual docs and pics everyone gets4

Thanks again2

Sorry, final question, how would you recommend sending the SAR? via email? Thanks1

Yes, via email, direct to their DPO which you can find by looking on their website.5
