The hired guns have a standard response to any awkward questions: ''Sir, I do not have any instructions on that point''.
Sometimes the Judge will order a short adjournment for them to go outside and make a phone call to the instructing solicitors. In one case I was involved in, the rep could he heard shouting into his phone When we resumed, his only excuse was ''Gladstones are very busy, and it appears this was overlooked''. The Judge was not best pleased, dismissed the claim with costs to the Defendant, and told the rep to pass on a message to Gladstones to the effect that they should not darken the doors of this Court again with such rubbish. Of course, Gladstones took no notice, and continued to churn out the robo-claims.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. We can all see that this is an obvious task, and its stymied those who've attended court so far, so maybe you can "think outside the box" and show them all how it's done!1 -
Gymbunnie - apologies that we’ve gone off topic. We are quite passionate at getting this stopped!I would follow Coupon-mad’s brilliant draft. It makes me so sad that you and others are going through all this and have to deal with these criminals (yes criminals). If you do get upset, don’t worry. It’s good for the judge to be aware of how much this has affected you. I wish you the very best of luck for tomorrow.3

So whats your plan to get past the "I have no instructions on that" standard response? Can you show us how to force Judges to deal with this?

Hi All,
Thanks for all this amazing advice, I had to admit defeat yesterday after staring at the screen all day and went to bed with a migraine, I had emailed the court who have now confirmed that they do have my evidence pack which was provided to all parties on time, but I think I was quite naive in my defence as it was basically bullet pointed and with no case law attached which I could really do with help compiling and a letter from my husband stating that it was his car and he was parked there (I know, please don't be mad, was trying to just tell the truth and didn't have your expertise then.
I had cobbled together a draft order, but yours is much better, and the email to Gladstones is brilliant! I think I need to add supplementary evidence, a stronger witness statement with the case files, can you please help I'm really up against it now, Thanks again you guys have been a real help, feeling a tiny bit more confident about tomorrow2 -
So I need to pull together, case law, abuse of process and britannia v crosby in supplementary evidence, submit the draft order and email to Gladstones and supply costs? I have absolutely no idea how much to apply for, I got lost on several threads yesterday looking for this, can anyone help? someone must have compiled a folder of case law before??1
