[Australia Question] - Tracking Landlord Down!

    Have you paid for a copy of the title deeds from Registers of Scotland as that will confirm if there is an outstanding mortgage and also the address he gave RoS, which may be here or somewhere else.
    Yes i have this but that is an old address in UK dont think the title deeds include details of mortgage that is purely for the property info, incidentally, i have a copy of an old  mortgage bank statement, there was a lot of bills left here from years back i've kept the lot.

    Yeah, I see it on title sheet, but there are no charges sheet on my copy, as I said above I have a copy of a bank statement detailing his mortgage payment and mortgage roll number whether it's still with them I do not know as it's about 9 years ago.

    If there is no mortgage mentioned then any mortgage previously on the property has been paid off.

    Mortgage started 2020, aiming to clear 31/12/2029.

    You should also be aware that the majority of offences under the law, either in E+W or Scotland, are offences against the crown and the state. So if he has broken numerous laws, chances are that you would not benefit from any prosecution. 

    In any case my point still stands, the only asset is the property there. and if the council is involved, they will get first dibs at any equity in that to pay off the substantial costs. 

    If you want actual advice on the actual problem, and how to best resolve it so YOU benefit, feel free to post the details. 
    All I want to know is what resources are available for me to locate him I do not wish any comments on why i am looking, what the issues are, I am already taking legal advice.  If you cannot provide any useful info on how to find him in Australia then please leave it at that and do not respond.  
    I've literally made a suggestion on how you can do it.

    If you mean, "can i do a basic search online to find him" - no. obviously not. 

    Hire an investigator. 

    If you know anything about internet you would know if it isn't posted online it does not exist and you won't find it; not everything is visible in the public domain!

    Be wise to consider what you post then.

    How much time and money are you prepared to 'spend' pursuing this dilemma? What is your cut off point because I'm not certain you'd get any money you spend back once you find him (if you do).
    I don't know Scottish law, but if things are as messy as they are and you're not paying rent, surely the mortgage lender will soon take steps to take over the property?
    I'd focus on finding somewhere new to move to once things improve here.

    You said you have something from years relating to the mortgage, with nothing showing on the title deeds it means there is no longer a mortgage on the property.

    Instruct am enquiry agent, let them trace him and then do what you want.

    i'm a bit baffled by your response at the time the title deeds are done it states that how the property is paid for is a mortgage it will not say if it paid off as its an exchange of contracts nothing more.
