UKPC letter following appeal

Thanks Fruitcake and coupon mad, looking at that I am not suprised the driver missed the signs, they also said that it was a rainy and overcast day so they parked right outside the shop, which on google maps if you park in the spaces directly outside homesense there are no signs in front of you, they are all behind you. Not something you would be looking for on a rainy day when you just want to get inside.
It seems that others have been caught out by the poor signage as well, I cant post the link for some reason but there is an article in a kent paper online from December of 2019.

This is important.Fruitcake said:When did the alleged event occur, and was the NTK PoFA compliant?
UKPC have one version that talks about 41 days instead of 28, for cases when they sent the NTK late.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The alleged event occurred on the 20th of February 2020, NTK is dated the 26th of February and the T&C's are:Coupon-mad said:

Wow, Its almost unbelievable that they would get something so fundamental wrong!Coupon-mad said:luvvvvvvly! A non POFA PCN then. They can't have 42 days AND 28 days in there!
Would that be enough for me to win through POPLA?
I have also today had Homesense come back to me asking for more details!0 -
Yes it would , if you are appealing as keeper and not as a driver
Quite a few numpty parking companies have failed POFA for 7.5 years , it's quite common , you would think that they would have addressed it , but nope , still foolish , so in your favour3 -
Do the retailer complaint FIRST though. nd exhaust that before even trying POPLA. Yes a keeper cannot be held liable by that NTK as long as the driver is NOT implied. It's not that UKPC have got it wrong, it's just one of the duff versions they use sometimes.
I'm sure most people say who was driving in their appeals and don't come here first; then it doesn't matter at POPLA and UKPC are laughing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi All, I thought you might like to know that our appeal to Home Sense was successful and they have informed me that the charge has been cancelled! Thank you everyone for your help with this.
Just one question, Is there anything I need to do at this end to confirm directly with UKPC that the charge has actually been cancelled? Just conscious of the fact that the store have told us its sorted but I have no confirmation of this from UKPC only from Home Sense (who are not the landowner only a tenant).3 -
Ensure that you keep checking the PCN status on the ukpc website
If it doesn't show as zero owing , or invalid PCN , or cancelled , write or email them telling them what you told us and demand a cancellation letter and to erase your data1 -
Is there an online portal where you can go and pay the PCN? (We had a Parking Eye PCN once with an online portal. We kept checking the PCN status and when it was finally cancelled via a complaint to the retailer it eventually showed as £0.00 outstanding to pay).1
