    I've attached an editable draft order if anyone would like to review it. Re the costs, I thought you could only claim costs if the claim was heard? If you are asking for the claim to be struck out, any costs pertaining to distress would be a separate claim, no?
    If the claim is struck out on abuse of process then you can claim costs based on the Claimant's unreasonable behaviour, pursuant to Civil Procedure Rule 27.14(2)(g)

    Protection of Freedoms Act 2012

    the fairness of a contract term, and the inclusion of additional charges

  • Should I be worried that I did not get an auto-acknowledgement email from the court when I sent my WS off this morning?
    In all previous correspondence with the court, I always received an acknowledgement.

    Have you had any previous auto responses from the court you have submitted your WS to, or just from the Northampton CCBC?
