holiday extras havent refunded me

    Holiday Extras have made a post on FB totally ignoring everyone complaining, despite saying they have read them. Unbelievable.

    Why would Holiday Extras using a 3rd party made any difference? It's like buying a Beko fridge from Currys  and being told that as Currys used a third party (Beko) you're not covered
    I put my Section 75 claim in today for my Holidays Extras payment with my credit card company (Tandem)

    aelengland,  if you paid via  Paypal  that is what is classed as a third party (only deal in the payment)
    If you paid direct to Holiday Extras then your Credit card company is wrong, it is not classed as a third party. You deal directly with Holiday Extras no third party is involved.  Who Holiday Extras deals with has no bearing on your rights under section 75 of the  CCA 1974

  • I have just cancelled an airport lounge and I too paid for cancellation insurance. It looks like they are going to try and send a voucher. A voucher is useless because the other 4 people on the booking want money, not a voucher, and two, if they are going to take this attitude, I'll never book with them again. The thing is, they have updated their T&Cs and I'm pretty sure they can't do that and then apply it to existing bookings. Does anyone have a copy of their original T&Cs?
  • Its a decent solution for those like me who booked non refundable products but its a kick in the teeth to those who paid for the cancellation cover, not even mentioned in the above.
    That's me. I'm not sure if they've weighed up the damage to their brand if they don't return the cash. It's not an amount worth getting lawyers involved in, but I'm not sure it's legal to charge an insurance fee that says you will get your cash back and then refuse to return the cash?

    The worst T&Cs I have seen are Holiday Extras they state
    "your booking terms and conditions allow us to cancel bookings without issuing a refund of any kind (due to it being a "force majeure" event"
    So they just want to keep everyone's money without paying out a single penny.
    I have no doubt that would be classed as unfair by the Consumer Rights Act 2015

    Under Consumer Rights Act 2015 a contract must be fair
    Generally, contract terms and notices are unfair if they put the customer at an unfair disadvantage

    "An unfair term is not legally binding on your customer."

    Clearly Holiday Extras contract regarding "force majeure" is unfair as it puts ALL the disadvantages on the customer but escapes their responsibility.

    This means under the legal Act above this clause in their T&Cs is NOT legally binding.

    You are entitled to a full cash refund no matter what Holiday Extras might want.

    I'm awaiting a full refund for parking 8/4/20 as they kept telling me if I don't want the voucher I must let them know which I did 30th and 31st March.

    It's interesting that Holiday Extras is being mentioned a lot on here regarding appalling treatment of customers. They also use a company called tifgroup as underwriters for travel insurance (mentioned above). Financial Conduct Authority figures show that in the two-year period to Sept 30, 2019, tifgroup managed to tot up an impressive 9,490 complaints. And, interestingly, just under 70% were upheld.
