Premier Park PCN Appeal

Hello all. Thought I’d give an update and ask for some advice.
Kames Capital claim they aren’t the land owners (they are) and refused to tell me who is (because they are) so for now I’ve just left them as they clearly aren’t interested. So now to ask for some advice. I’ve contacted my local MP as stated previously in the thread. She sent a letter to premier park and they replied saying I had to fill in some form and return it within 10 days or they will not reply to my MP anymore. Due to the lockdown and problems with getting the post redirected for my local MP, our response to that letter took more than 10 days. I have looked through the BPA COP January 2020 version and it does not state anywhere that there is a 10 day deadline which the PPC can ignore you if you do not meet. It would appear that this is a self imposed deadline by Premier Park. As this has been going on for over 28 days now and my MP has chased up a response TWICE, I now intend to complain to the BPA about a breach of the COP.
Here is a quote from the relevant section:Motorist Correspondence
9.7 At a time when the private parking sector is under intense scrutiny from Government, it is imperative that correspondence from MPs (and similar VIPs) is dealt with promptly with definitive and comprehensive responses given. When such correspondence is received, we expect you to acknowledge the communication within 10 days and respond within 28 days. If the complaint will take longer than 28 days to resolve, we expect you to update the MP of this. Failure to achieve these deadlines may be considered a Sanctionable Breach of the Code.
As we’ve not received a response or an excuse as to why this would take longer than 28 days, I can only conclude this is a sanctionable breach of the code.
In addition to the above, in the original reply to my MP, premier park stated the charge was on hold for 10 days, but approximately 8 days later they sent me an email chasing payment with no mention of any correspondence being sent to my MP. They are telling my MP one thing and telling me another. This, in my opinion, is absolutely disgusting practise and I would like to complain to Steve Clark at the BPA about the issues I have raised above.
I informed my MP that I was going to write a complaint to the BPA and she has said to send it to her first and she will also send a complaint which I was really chuffed about
I am looking for any advice as to how to go about this and end this sham of a PCN claim asap. I have Steve Clark’s email address ready to go.
Thanks all.

Thank you CM. That was a fantastic discussion and could not have been better timing. I will refer to it in my complaint.Coupon-mad said:OK, and how about giving Steve Clark and your MP a heads up to the discussion about Premier Park's conduct, in Parliament only last night?! Hi all. I’ve been speaking to Savills, the land management company and provided proof i was using the shops on the day my PCN was issued. They requested premier park cancel the PCN, however this was 8 days ago and it’s still not been cancelled. My case at POPLA has still not been heard, but I only submitted a holding appeal anyway.
Should I email Savills again to chase it up or just save the email correspondence for POPLA or court?
Thanks all.0 -
I would wait for at least three weeks. Then send a reminder quoting the telephone conversation.
Have you complained to your MP?You never know how far you can go until you go too far.0 -
Cool. It was an email, so I’ve got it in writing.D_P_Dance said:I would wait for at least three weeks. Then send a reminder quoting the telephone conversation.
Have you complained to your MP?Yes I complained to my MP on day one and it was very beneficial. She will send a complaint to the BPA with me which I mentioned a few posts back. I’ve got the complaint ready to go which I already sent to her to read and she said it was ok, but I was waiting to see what happens next. If they cancel then I probably won’t bother because I just want it over with.2 -
If you haven't already done so since the Savills response, check the PP website by logging in and reviewing your PCN there. That should tell you its current status.Chiggings said:Hi all. Thanks all. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
