CEL COURT HEARING NOW BEING HEARD OVER TELEPHONE DUE TO COVID 19 PANDEMIC.

  • ps OP, remember you could have a future claim if you were able to prove that the company did not have the legal right to bring proceedings against you.  In which case, if you do decide to pay, maybe think about including a letter saying you are paying under duress as the telephone hearing was unfair and that you are only prevented from an appeal due to the anxiety that has already been caused to you.
Someone at some point may be able to obtain a copy of the landowner agreement.

If however you do decide to appeal I wish you the very best of luck - you deserve to win.  Zhong

No one is suggesting that OP fights this if they cannot afford to, what many/most are saying is that, if he can afford to, he should.

I thought OP was a new homeowner and had raised the point (apologies if I am wrong)

Perhaps, but we are not talking huge sums here.
You never know how far you can go until you go too far.

It's not about the PPC's using this if the OP does decide to take this to Appeal &  if by some miracle they did win would be use against others, itself more about justice for the OP and a fair hearing.
The PPC know that it is a postcode lottery when they take the claim through the CC system (and believe that someone reading on here that one rep did say to a Judge it was) in the hope they get away with it....it's a numbers game.
I am no legal expert but how can any Judge make comments like they did and still find in the claimants favour?

"We have landowner authoritie believe us" without actual proof.

The additional £60 is not allowed and took it out, so a clear case of abuse of process.

Totally dismissed the OP Defensive on many points...really...

I believe this kind of win just gives the PPC to push even more and even take advantage of the CC lockdown in pushing for more telephone hearings.

I know that cost is a big factor also the OP time and effort involved, I am not a betting person but for £150 would take a pun at it with the support of people on this forum.
    Just my thoughts....

I am uncomfortable that a brand new poster has offered to help pay the court fee for appeal.

Might be wrong but I smell a whiff of a possible post from a private parking appeals company and we NEVER EVER recommend getting caught up with their ilk.  Worse than parking firms, IMHO.

In fact re one notorious firm, where it is in the public domain that several good guys & gals resigned years ago, Trustpilot reveals that since the resignations (Companies House confirms my facts and I was one of the resigned Directors so this is all true...) the firm has the worst review record known to man/woman for any firm we've ever seen, and Trustpilot even has a banner headline warning about them, and among the reviews is confirmation from the firm themselves, gloating that they sued a paying customer who ended up paying them a grand, for daring to post a Trustpilot review.

This is not how life should be, IMHO.  I am personally embarrassed at what has happened and am really uncomfortable about a new poster looking as if they might be associated with 'it'.

OK, fair enough - it was the concern about the lack of posts you had that met the profile for what they do when they post here.  Honestly worse than parking firms; run by people you really do not want to know or hand data to.
