Ordinary costs were awarded for loss of a day’s leave, travel and, parking. 40 hours LiP costs were awarded under r27.14(2)(g) (after breaking the costs down for the judge). A further £120 was awarded ‘in principal’, pending further submissions in the next 14 days. £15 for stationary, printing and copying was refused. Total costs £989 (£120 reserved) £869 to be paid to the D within 21 days.

Hi all, just wanted to update you. I had the telephone hearing last week, claim was struck out and dismissed! The judge had no further questions to ask me but ripped apart the rep for VCS who coincidentally wasn’t Yasmeen. He had no clue about our case or the airport in question so didn’t make himself sound too clever over the phone, they did appeal the decision so we will wait and see if they take it any further. Thanks all for your help, a great outcome!!6

That's fantastic - well done and what a relief.
I am just starting the process of appealing as similar no stopping fine for the same slip road. I am appealing to the IAS first and then will see where that gets me. I was stopped in front of the barrier reading the signs before entering the short stay car park. Did the fact that VCS shouldn't be covering the slip road as it's not included in their contract have any bearing on the outcome do you think? Also can I reference this in my appeal with IAS do you think?2 -
I'd certainly reference in your IAS appeal if it's for the same location and "offence". (As long as the OP is willing to give the case details ... VCS vs __________, case __________ at __________ court heard by Judge __________ .... with the blanks filled in).5

For my case, nowhere in the Vcs whiteness statement did they specify the material location. The judge did pick up on this which lead to more questions that the rep couldn’t answer.The main point the Judge reiterated is that no reasonable contract could be formed for ‘no stopping’. Perhaps no waiting or no loading but there are too many variables that could cause you to have no choice to stop.If your case is also at Bristol airport, you’ll notice the signage wording is very basic, and makes no mention of any additional charges, which the judge also pointed out.4

The main point the Judge reiterated is that no reasonable contract could be formed for ‘no stopping’.That, is significant!If only that came via a higher court decision, it would put a huge hole in VCS 'No Stopping' nonsense.Please note, we are not a legal advice forum.
