    Tailgating - whatever next?  Speeding?

Its an unmitigated penalty.  The DVLA have to sort this out, otherwise almost any slip up by anyone anywhere near a vehicle with a visible VRM will have their details handed out on a plate by them.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yasmeen Couser has been at VCS for over two years.
    Or has she?

Because, she also claims to have been employed by Excel since January 2018 as well; and whilst it's possible to be employed by both companies, it's more likely she only has one employer.
I think that it's one legal department for both companies. They don't seem to deal with the likes of BW Legal or Gladstones and use firms like Elms for representation in court.  I don't think that Yasmeen Couser signed the Excel WS in my case in early 2019.

She signed the WS for both "Troubled42" and "FiortDunlop2020" claiming to be an employee of Excel Parking Services Ltd.

Unless she has separate contracts of employment, then she's acting as a third party for one of the companies.

I would be careful using some of these staff reviews. It might be useful to demonstrate that the employees are targeted. It looks as if they are given a hard time if they don't produce results.

This is what happened with PPI.  Staff were pushed into selling it to people who were not eligible.
Sounds like it's not just the motorists who are "targeted"; although some of the reviews were difficult to read.

(Apparently there may be more PPI claims in the pipeline according to the newspapers).

It sounds a very toxic environment to work in. It's hardly the ethos of someone like W. A. Cadbury.

I think that some of the reviews were from people where English is not their first language. It appears that they dock money from their wages on a regular basis.

I think that the review that you have posted above could be used as evidence that they do work to targets.

I wish that an employee from Excel (or ex employee) would whistle blow on their practices.

Please show us the whole of their WS. Does it include their evidence of someone actually getting out of the car as opposed to the car just being stopped in a queue?
That is the whole thing, bar a photo of the entrance no stoppping signs, and other no stopping signs. There is no photo of a sign at the material location, because there isn't one. The only photos of the vehicle in question are way at the end in amongst the letters they sent to me... I just checked the SAR, and they have included 4 more different cctv stills in that than they have in the witness statement. I think those other photos better show that the car is in a queue, so will be sure to include those in my bundle. Attached here if anyone wants to see. The photos they have included in their bundle are 05, 15 and 20 seconds.

It is the honest truth that no one exited the vehicle for any purpose other than looking to see what the holdup was... someone else is doing the same in the last photo... Don't know how best to approach this in the witness statement, if at all.

Have you complained to the DVLA about the release of the keeper's data?
Yes, Twice now, but still no reply other than the automated email to say they have received.  Not sure I will have time to follow this up before the witness statement is due on monday.
The lengthy WS full of irrelevant material does them no favours. The representative usually gets this just before the case and they have to try to find the main issues from the PPC's lengthy WS. That's why they like a little chat. They want you to do their work for them. Don't be fooled into that.
Do you mean the Rep from the PPC likes a little chat with me? Not a chance!

I don't think I appreciated how many posts of similar situations to this there would be... Hopefully I will get my witness statement to a more substantial state tonight.

I would be interested to hear what peoples opinions are on how to proceed with regard to the extra photos from the SAR.

With regard to the photos it's very obvious that you have not stopped as you would have pulled over.

There is a comment from an employee/ ex employee that is quite relevant to your case.

Yes the rep from Excel/VCS will want to have a 'little chat'. The reps are usually not from the PCC itself but from a firm like Elms legal. They will say that the judge wants the parties to the case to decide on the main issues beforehand.  You don't have to do this and could disadvantage yourself.
