    Sometimes fares through good agents can be cheaper and right now, a lot of airlines are in deep financial difficulty and could possibly fail and the airline failure cover you get for a couple of pounds is surely worth it. The £2.50 ATOL fee goes to the CAA at the end of every month, and it is a one way street, government departments do not refund. It protects you in case the agent ceases to trade and again I fear that will be the outcome for some agents in the next few weeks, just because you don't make a claim on any insurance policy you buy does not mean you can have the premium back!

    Any fees have to be legally "fair" otherwise they don't count.
    The trouble is there is no legal set figure for what either fair  or unfair is.

    I think we can safely concur that £200 would certainly be unfair and therefore invalid.

    But if I was charged that, then would be doing a lot or research  trying to find out what courts have ruled in the past, if I was thinking of taking it to court.

    But if I was being charged that amount, I wouldn't claim from the travel agent but the Credit Card company S75 if over £100
    This way I don't have to pay any court fees and the Ombudsman would decide it's fair

    Despite the often alluded to threat of Court Action by Travel Companies for "defaulters" there is no evidence I can find of it actually happening. This leads me to believe a lot of them are aware that their terms and conditions would not stand up to scrutiny and rely on peoples fear and ignorance to ensure they blindly acquiesce and cough up or don't exercise their rights to challenge unfair terms.

    Indeed it does seem like a cheap lesson, although Travelpack were cheaper than the airline when purchased the ticket. I thought it would be no harm in asking if there was anyway of getting the £4.50 (thats a least a pint of beer in my book :grin:). 


    The £4.50 sounds like the price for the SAFI. You are using that to claim the refund so it is spent.

    Thanks all. I've had a reply stating that it will take up to 10 weeks for them to refund my card.
    Fingers crossed I get my money back by then :smile:

    We booked flights to Bali with Cathay Pacific through Travel pack in September last year. 
    As things have progressed, our flights have been either changed or cancelled.
    I have contacted Travelpack about getting a refund for the flights, £1400, they are now saying that Cathy Pacific have taken over the booking and therefore Travelpack are not responsible for the refund. Having contacted Cathay, they state that they are not responsible for the booking as they have not received any money for the tickets.
    Where do I go with this next??
