  • Whilst the specific content of your email wasn't ideal, it was good enough to get the main point across. Not having it headed WPSATC is good as it means you can include it as evidence during Witness Statement stage (if you wish) to show how unreasonably the claimant has behaved; how they had little or no prospect of success, were given clear information that this would be the case, yet still chose to waste the court's (and defendant's) time on a fool's errand. :)

  • Just wait ... and use their own evidence to pound them.

    PS - I hope you didn't send that email headed Without Prejudice Save As To Costs. That way you can include it in your evidence to show the unreasonable behaviour of the claimant.
    Ok thanks everyone. Lesson learnt in not running this by here first. I’m not sure what you mean here. The email wasn’t headed with anything? 
    WP - you cannot ever show the communication to a court
    WP save as to costs - can only be shown to a court after judgement is given.

    Well done, and thanks for letting us know. Do check with the courts as advised and proceed as if the case has not been dropped until you get the court order confirming it.

    I wouldn't put it past the scammers to tell a defendant it has been cancelled, then go ahead anyway to obtain a default judgement.

    So I've filed my defence, but think I may have been too hasty and just sent it off on the website before reading the defence thread on here. My bad I know. But I have asked PPS for the PDT printout on 08 October, they told me to contact BWL for it which I have on 20 October, 27 October and 04 November. Each time they tell me they have requested it from their client but can't give me a timeframe. Should I just keep emailing them and asking for it or just leave it and show they are not co-opporating?
    Oh dear.  You are stuck with that defence now.  Why did you do that, it could lose you the case.

    What did you put as a defence (word for word, please).
    Yeah, I know, I messed up. I was having a real bad week and wasn't really with it and just did it. Here it is word for word

    Defence

    I dispute the full claim. Premier Parking Solutions (PPS) state
    there is no trace of my payment, however, I have in my possession
    a ticket for the car park in question that more than covers the
    amount of time I was in the car park. When I paid for my ticket, I
    put my VRN into the ticket machine and the machine then
    asked me for payment. I put in the correct amount of money and
    paid for my ticket, displaying it on the dashboard of my car. For
    some reason, the machine only printed the first letter of my VRN
    on the ticket. My VRN is MT68EPF, so just M was printed on the
    ticket. PPS rejected my appeal saying there is no trace of my
    payment, however, there will be a corresponding entry on their
    ticket machine that shows the date and time I parked and ticked
    printed with only a M on, matching the ticket I have in my
    possession, making my payment traceable. I have requested a PDT
    printout from PPS to cover the time I made my payment so my
    payment can be traced, however this
    has not been forthcoming. PPS have suffered no financial loss as I
    bought and paid for a ticket for the amount of time I was in the
    car park and I have the ticket as proof. I should not be held
    responsible for the failings of PPS's machine.
    I am so glad that, even with a short defence, you'd done enough to kill this ludicrous claim off!  Well done! 

    No wonder they cancelled; this situation below creates no a cause of action against a driver for any breach of contract:

     I paid for two hours and was in the car park for just under two hours. The ticket only had M printed on it, which is the first letter of my number plate, but if also had the time I bought the ticket, time it expired and 312185 on the bottom of the ticket, which I assume if the reference number for the parking machine.

    Another BW Legal / Premier Parking Solutions one bites the dust!
