As people will likely be aware, POPLA said 2 weeks ago or so that they require full appeals which had been placed on hold due to covid to be sent within 21 days. I am therefore sorting my POPLA appeal out as we speak. I have been back and visited the car park today and taken plenty of photos. The first point I am going to appeal on is the signage - tiny £100 fine text on the sign which I think is a valid point. I have just taken the signage template from the newbies currently. One thing I noted was that the on the gates to the car park, their sign is virtually not visible, it is behind the side of the gate on the left hand side, which you can barely see because there is a bush on the left hand side before the entrance, and the actual sign itself is behind a metal fence with gaps in in which makes it impossible to read - can I tweak the signage template to discuss this?
Second point, I am thinking about the evidence regarding the time the vehicle was parked (and then third point would be about the BPA grace period) - the photos they have of the vehicle on the website are only timed 1 minute apart, think the first is 8am and then the last is 8:01 - so will the point of evidence regarding time parked be valid? And therefore the BPA grace period a valid point as well?
Other points I am thinking are the landowner authority point as this is a residents car park, and then I think the only other possible appeal point would be on non-compliance regarding the vehicle images, however, I need to research this further to see if this is possible. I will keep research for these 2 points.
Regarding notice to keeper etc - They have they POFA 2012 stuff on the front and I have double checked against the legislation and think they have covered off all the requirements, so unfortunately don't think I have a point here. The parking charge date was 29/01/2020 and the NTK was dated 02/03/2020 so complies timing wise also.

Tweak the signage template if that's necessary to make it fit the circumstances . But if there's nothing there that jars then include it as it is and then devote a paragraph (or more) to the specifics of that car park.
Embed your photographs in the appeal and number them for reference. Then you can go to town on the ways in which the signage on the gate is obscured and on any other signage failures. Make clear reference to the photos that illustrate your points.5 -
Just sussed something - the actual NtK (the letter received) states the following:
'Residents must be parked within their designated bay' ...then underneath... the address of the building XXX 'on the 29/01/2020 07:59'
Have they therefore failed to comply with POFA 2012 paragraph 8/9 (2)(a) which states “specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates;” ???
I also still have the windscreen PCN which has 'Issue time' as 07:59 and 'Time first seen' as 07:59 and then the text 'Residents must be parked within their designated bay' - does this further work in my favour?0 -

If you actually live there and have a valid clause in your lease (ownership papers) surely that is your first POPLA point, the PPC cannot offer you anything that you don't already have. Forgive me if I am going over old ground, as I haven't read back through thread, but have you read other residential POPLA appeals on this forum?2

Your first post states:-"29/01/2020 - PCN - NOT parked in my own space (parked in a random space as gf had her car here) for 1 night and came out to a PCN at 07:50am to go to work. I have caught this at the appeals stage so will just go ahead with the generic appeal? NTK received 02/03/2020"!this suggests that a NtD was issued i.e. a manual observation of the car.Your para 5 in the POPLA doc talks about Smart Parking and ANPR - is this relevant?1
