Fruitcake said:twcat, I was thinking the same thing. How can a dormant company that does not have a contract to operate on the OP's residential site be sending demands for money with menaces?
Are they declaring any income to HMRC?
I have been in touch with the DVLA and Companies House. Will keep you updated when I receive a reply, twhitehousescat said:as parking are and have been showibg as a dormant company since about 2016 , you may want to ask companies house why are a dormant company writing to me ? , also ask the DVLA , who asked for your info

Glad you got the 'c' in that. Could have caused a row between regulars! 😂Fruitcake said:twcat, I was thinking the same thing. How can a dormant company that does not have a contract to operate on the OP's residential site be sending demands for money with menaces?
Are they declaring any income to HMRC?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Update, I have been issued with another PCN...
I parked in the 'Visitors' bay last night and was issued a PCN on the grounds of... well I don't even know.
The 'visitors' bay are not identifiable by writing on the ground, neither are they identified on the parking signs above the spaces, nor are they described in the lease. I have provided photo evidence of the conditions for the 'Visitors' bays which are followed; https://ibb.co/89bjKbD
(copy and past link);
The condition that I wish to draw your attention to is 'without a *Valid Permit', outlined underneath as; *Permits are not valid for commercial vehicles parked between the times of 'X' and 'Y'.
There is no further detail on this matter contained in the sign, which offers a very broad interpretation.
At the time my vehicle (not commercial) was parked in the 'visitors bay', I displayed a Permit issued by Alliance Parking.
Photo evidence here; https://ibb.co/R9nXWw9
Contained on my Permit, is the 'details of Vehicle/ reg' - which hasn't been filled in, but instead replaced with my Bay Allocation?!
There isn't even an allocated section on the ticket that instructs you to park in an allocated bay other than what they have roughly printed on the Reg section.
I wish to draw your attention back to the definition of Valid, this permit was issued by Alliance Parking, for the same piece of land, while still being within the specified dates. How could you argue that this is not a 'valid permit' which falls under the broad definition, or arguably not defined on the sign positions above the 'visitors bay'.
Furthermore, I have also included a permit from last year. I was issued two. one was exactly the same as the one shown above (in green) and the other which had 'Visitor' written on in pen. I had lost the one which had my bay number informally written on, so scribbled out the wording "visitor" and instead wrote my vehicle reg while using it universally in both bays (allocated and 'visitors') no PCN's were issued to me for the whole year.

This company is infuriating as the terms differ for each parking representative issuing notices.
Next course of action, Is it even worth appealing if they are going to reject my appeal considering Coupon and Fruitcake said the company is just out to scam you?
Update on responses
No reply since from Landlord (as away at the moment) or from MP.
DVLA & companies house have responded;
Companies House suggest I get in touch with Insolvency Service if A.S parking are excising corporate abuse, but as Castle commented earlier, how do I go about differentiating between who sent the Email; A S parking or Athens security? The email I received was headed in my inbox as "A S Parking <noreply@parking-enforcement.co.uk>".
DVLA have stated that I need to send a V888 form off to them to recover the relevant information, so will be a few days until that is sorted.

You appeal because it looks best in court later, and helps the Judge to see that the later litigation is meritless and the dispute was clearly resolvable, had they bothered to read your evidence and realise you have a permit.
That is the reason for appealing & keeping all the letters - as evidence.
You need to get them kicked out, get other residents together and remove them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

A company must by law disclose its registration name, number and registered address on every email sent; so I would send a copy to Companies house and ask them to investigate.360ollie said:

DVLA have stated that I need to send a V888 form off to them to recover the relevant information, so will be a few days until that is sorted. You appear to have either asked the DVLA the wrong question or asked the wrong department.
From time to time Umkomaas posts this:Email the DVLA and ask which organisations (when and for what reason) accessed the registered keeper's data from them between a range of dates which includes the date of the parking incident. You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

This service is free of charge.
Even though you email your request, the DVLA will respond via Royal Mail.

That's not the case for every email and no-one cares about it, certainly not Companies House.

in very very un readable writing on the contact us page , it states this "A S Parking is a trading name of Athens Security Services Ltd. Registered in England: 06379383.Registered Office: Unit 1a Newquay Road, St Columb Road, TR9 6PZ"
the company number points towards athens security https://beta.companieshouse.gov.uk/company/063793832 -
I have appealed and sent the emails addressing my concerns to the suggested above so I will just wait and see/ confirm once I receive the replies.I hopefully have sufficent evidence that if it every does reach a small claims then it will be thrown out.
Thank you for all your input so far!1 -
Hi all, hope you're keeping well during these times.
I have received a letter before claim from the company today,
https://ibb.co/ZN90SNy
I am happy to take this to dispute this through ADR and court if need be as I am relying upon multiple factors which I believe will provide me with a strong case;- Promissory Estoppel,
- They do not make money from providing tickets to park on the land, they only do this through issuing fines. (Even if they are paid by the management facilities, My girlfriend pays rent)
- Parking alliance had issued the Parking badges but they were still in the post. (the attendant said a note in the window was fine explaining this), No payment is needed to park there
I will acknowledge proceedings by responding to their claim as well as submit a defence based on the factors above to comply with Part 10 & 15 of the practice directions.
I will be providing defenses for different 3 claim letters (2 yet to reach the LBC stage) in this 1 response to save costs and time so that I am acting in good faith with the Overriding objectives.
If it does continue to ADR, what would be the best route to take, I do not wish to settle as I am not in the wrong, neither am I financially able to pay these as I am still a student.
Furthermore, I cannot make a 'without prejudice offer' because the only way they make money is from issuing fines, there is no ticketing machines on the land.
