So I've just sent my DQ to the court and i got this autoresponce from them
"The time of receipt of a transmission will be recorded electronically on the transmission as it is received.If a transmission is received after 4pm any document attached to the transmission will be treated as filed on the next day the court office is open."
So if the court did receive it after 4pm then it will be recorded as being delivered the next day4 -
should be pointed out to the Judge right?Yes, that the WS and evidence were served to you as a matter of fact, at 4.40pm and you ask that the Judge checks when they received their copy at the court.
It's deemed a day late, which in itself SHOULD be something the Judge will have a problem with, but there is more! Ask the Judge what he/she thinks of the solicitor trying to show that their emails were sent earlier...what does the court make of it?
Explain it then go quiet and let it sink in, as long as the Judge understands what you are getting at.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Tomorrow at the hearing do I address the Judge as Sir / Madam? Also is there a rough guide to show how the hearing might run? What will be said , when I speak etc.. I couldn't see anything on the telephone hearings thread.0

The Judge will start with the claimant and then talk to you and listen to your defence.
The Judge is in charge so don't interrupt whilst they speak. The same applies to the claimant
Wait until the claimant stops talking. If there is something you disagree with, you of course can ask the judge by saying something like "Sir, may I speak" Keep calm at all times because some of the reps the claimant sends can get a bit noisy ....
It is no big deal, promise you and make sure you have the CRIB sheet and stick to it.
When you win, you say "Thank you Sir/Madam", and ..... don't forget your costs
