Like I said yesterday, yes - because you have missed the monumental changes coming in and your documents were all written before the new proposed Code and intention to ban the fake DRA fees - there is a reason why you need to update with a new SWS and updated costs.

So, just to absolutely clarify ... you have NOT received (at any time) a copy of the Claimant's witness statement?

  • @Jenni_D, sorry, still getting used to the lingo and misinterpreting questions! YES, I have received claiment's WS.

In that case you can use the opportunity for a supplementary WS to call out any obvious errors (or mistruths) in their WS. :)  (But don't get embroiled in tit-for-tat email tennis if they respond with their own SWS - keep anything additional in your crib sheet for the hearing).

  • Quick update on my hearing, received the following email earlier today:

"Please be advised that due to a lack of judicial time, in the **** Courts, the hearing will not go ahead, please do not attend court on this day. Unfortunately the matter is having to be stood out of the Court list.
We will relist this matter as soon as possible and a new hearing notice will be provided in due course.
If you have any queries please email them **** County, Enquiries"

Now that I have even more time I am wondering if should rewrite my WS completely due to considerable change of the Government's stands on Private Parking Industry? Any thoughts and comments are welcome.

No you can't - unless the letter also states that both parties can update their "documents upon which they will rely".

The government intends to make changes to the way the private parking industry operates, but it is yet to be implemented. You can mention the government's intention, and that the former head of the DHLUC said the fake add on charges are an attempt at extortion, but it is not mandatory, and a judge may or may not take note of it.

I suggest you show us the claimant's WS to see if the regulars can spot anything that might help you.
Redact personal information but leave in anything that is already in the public domain.

  • @Jenni_D, thanks for prompt answer. How do I then provide previously suggested "updates" by @Coupon-mad and others? Is there some kind of addendum to the WS?

Supplementary WS ... that was already mentioned earlier in the thread. This does not allow you to introduce new arguments, but allows you to provide additional evidence and clarification - plus respond to errors in the Claimant's WS.
