Tesco staff taking photos on behalf of parking company

    Of course they can , they have 6 years to issue a court claim for an unpaid invoice

    How did you get on with the 5 complaints Coupon-mad suggested you make?  Surely one of those will have seen this cancelled by now?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    So since my last post I have visited this Tesco Express twice to speak to the manager again. The first time he was conveniently away and the second time I just about managed to speak to him but he did not seem interested at all. I did raise my voice but, unfortunately, there were no other customers around at the time to have much impact. In summary, this what I was told:
    - he has no control over the parking fine and can't get it cancelled 
    - he can't contact the parking company (Horizon) and I need to do so
    - nearly 5 to 6 customers per day have reported to him not receiving the £20 discount before the £70 letter. Again he said to contact Horizon
    - he could not care less if I did not shop there again

    I rang Horizon and they said I should submit an appeal through their website and they will investigate. Is the following sufficient for an appeal:
    Hi. I received a PCN letter in the post on xxx. The letter was in relation to an incident that took place on xxxx at Tesco Express [address]. The letter stated that a PCN was issue with discounted amount of £20 but this was never received. In fact, this is the first I have heard from Horizon or Tesco in relation to this incident. I have been into the store to speak to the manager and he has said that this is not the first time he has heard this and actually 5-6 customers per day have come into the store to complain that they too never received the £20 letter.  He advised to call you, which I did and the person I spoke to advised to submit this appeal. I would appreciate if you could please investigate why this has happened and give me a fair opportunity of the discounted amount. 


    Well, if any customers to this store get a court claim, then they should be asking this manager which dates he can't attend in court....

    This is the route Tesco are taking proving once again that they are really not interested in customers.
    As the staff are probably not registered by the BPA, the issue of tickets will not be legal and especially Horizon obtaining details from the DVLA.   You need to ask for the name of those taken photographs and if this refused, get the name of the manager who is responsible for his staff, then ask the BPA is this store registered to act for a third party, they being Horizon

    Strange though, there was an advert on TV by Tesco saying they will match prices from Lidl ????   Tesco are a company losing business and clearly they don't know why.  A child could tell them ???
    Think the child has pointed out to them that they and the others in the big four are losing out to the budget supermarkets Lidl and Aldi (who have been benefitting from the years of austerity). They have also been going a bit upmarket too - with wine etc. Clever marketing.

    Someone at Tesco has realised that cost of shopping is a biggie for people and they are trying to get back at Lidl and Aldi where it hurts. Interesting stuff. 

    Having said that this Tesco's manager's attitude, as reported, is terrible

    Agree though about using own staff for ticketing. Not on. Our Waitrose did it when I moved down there but the confrontations were not good  for the staff. I might be wrong but have a feeling one got beaten up (that might be local pub Chinese whispers, though!)




    Yes, Lidl and Aldi do use PPCs. I think Lidl use someone like Euro Car Parks (as does our local Morrisons), can't remember who Aldi use.

    If exclusive store car parks:

    Lidl - Athena
    Aldi - ParkingEye
    Morrisons - (increasingly) Euro Car Parks, but PE still operate at many. 

    All these stores are very receptive to a request to have PCNs cancelled (especially, but not essentially, for genuine customers with proof of purchase) and should be the first port of call before any appeal to the PPC (provided before the deadline for the initial appeal - don't miss that).

    MP said they will look into it and I've spoken to the store manager on a number of occasions but he's not interested. No response from the others. 
  • Thank you to everyone who has responded. I should also point out that the PPC has not even acknowledged an appeal was submitted, so surely this is a breach of the BPA code of practice?
    31.8 You must acknowledge or reply to the appeal within 14 days of receiving it. If at first you only acknowledge the appeal, or your reply does not fully resolve it, normally we would expect you to seek the additional information you require from the motorist and accept or reject the appeal in writing not more than 35 days after the information required to resolve it has been received from the motorist. It is acknowledged that in exceptional circumstances, an investigation into a appeal may take longer than 35 days after such information has been received and in these instances the motorist must be advised accordingly and given a date by which they can expect a resolution. If this date cannot be achieved then the motorist must be written to again and a revised resolution date agreed. We may require you to demonstrate that you are keeping to these times
