I have just had my telephone hearing and I am pleased to tell the forum...I won!! I felt rather tongue tied at times and a bit flummoxed but the Judge seemed to know her onions and ruled in our favour. Unfortunately no costs were awarded. The Claimant seemed to be very well rehearsed (he should be, as he probably deals with these all the time) and I couldn't find the right words to defend my costs and as such these were refused. :-( I am just so relieved this is all over. Does anyone know if the transcript of the case is sent to me? It was all such a blur.
Thanks to everyone on here who has helped me, especially @Coupon-mad and I apologise if I was snappy at times. Please remember this is a very stressful and scary thing to go through, I've had so many sleepless nights and the fear of the unknown is always worse.5 -
Well done on your win against HX and gladrags , a win is a win and costs are more problematic when it's a telephone hearing unless you can justify half a days wages etc
Transcripts have to be ordered and paid for by you , not cheap !!
You will get the decision in the post
When you get chance , give us more information , especially the reasons that you won on , so we know which advice is good and which isn't so good
Another one bites the dust !!3 -
Well done and a great win against an advocate who's no doubt done this before. 🥂Does anyone know if the transcript of the case is sent to me?You only get a transcript if you pay for one (and the cost will probably run into 3 figures). What you should get is a written judgment by the Judge, which won't amount to much more than a couple of sentences confirming the outcome.ANOTHER ONE BITES THE DUST - KENNY KONKERED!Please note, we are not a legal advice forum.
