>> Where I come from it's enough to call the police and after reviewing the evidence and interviewing parties the public prosecutor is taking care of it.<<
So where are you from? If it's not the UK, and you know this is a UK board. Why post here? As this is not something the police would even deal with.. Especially as you are talking about London.
>> Private trader <<
Whats one of these.
Its either a Trader/dealer, or a private (Joe Public) sale.
You said in the previous post
>> Ford local dealership said they can only check mileage by visually reading it from the dashboard.
We phoned Ford UK technical support and they confirmed this model stores data in power steering module and although it's extremely difficult to reveal the data from the module using specialist software it is possible <<
Now you say
>> Local dealer can't read the data from MCU or steering module, private party can so as Ford UK Technical Support.<<
So just who is this local dealer? Ford or not?
Your story keeps changing. If a Ford dealership is unable to read this data, then how can a 3rd party?Life in the slow lane1 -
If the dealer was unaware that the car had been clocked then legally they've done nothing wrong (how can they have?). They can only describe a vehicle to the best of their knowledge.
You do have a civil case against them though.1 -
Clocked ?? or new speedo fitted .Big question is what does the buyer actually want now as they know the law etc .0

Born_again why so many silly questions and attacks?
Ok I'll answer your questions but please do me a favour and stop visiting and responding to this thread again.
I was born in another European country hence my comment where I come from. Been living in UK majority of my life and consider it as home.
If you by now didn't figure out the case is taking place in London please again stay away from this topic...
Private trader; apologies, it should be motor trader, again if that was too difficult to figure out please kindly stop answering to this conversation.
And also if you can't understand how 3rd party specialist can often know more about certain cars than mechanics at dealerships please stop commenting any car related threads...
JJ_egan - surely this would be indicated in the paperwork car came with (service / repair book) and after that the car should not be advertised with mileage displayed on the Speedo without revealing previous original mileage.
All I wanted to know is what are our legal options if any. Now I know.
Garth549 - thank you. Looks like you're 100% right.
Just out of curiosity..why nobody mentioned Motor Ombudsman in this thread?

Attacks... You jokin.
I learnt long ago never to ASSuME (work out what that spells out) when someone says something that does not make sense to me.
As you ask I'll not bother anymore.Life in the slow lane0 -
Neilmcl - you're absolutely right. The motor trader isn't registered with them and they can't have any control/involvement with him.
If he was registered with them they could lead the case to a resolution but unfortunately not in this case.
I'm still waiting for an official letter from Ford Technical Information Center confirming the location where data is stored and also hopefully giving us details of one of their (ford) garages where they can do the proper check themselves and confirm correct mileage.

DoaM thank you for your input. Moreover, the dealer knew the car was used as private hire and never disclosed this information until confronted. Advert on Autotrader never mentioned any business use. Could this fact be in our favour?0

Yes - they failed to declare material information that would influence a consumer's buying decision.1
