Just had a phone call asking if I wanted to settle out of court. I asked if there was any other reason they are calling other than trying to fleece money out of me! Apparently it may be a phone hearing.0

Nobody could settle a scam out of court. Email them back and say that a phone hearing would not be possible as an explanation is required in front of a judge regarding the unknown amount they have addedAllye said:Just had a phone call asking if I wanted to settle out of court. Any phone hearing is due to social distancing due to the pandemic , things are not normal at the moment , think about it , judges are working from home0 -
A 'phone hearing would only work if all parties have a conference call facility and know how to use them. I haven't and I don't, so I would not be able to do this and would be at an unfair disadvantage if I did such a thing by 'phone. I would only be able to converse with the judge and not be able to question the claimant.
Staying the claim seems to be the only fair option.

I too would struggle with this techie stuff, I do not even have a smart phone. Insist on a face to face hearing.You never know how far you can go until you go too far.1

well it’s booked for April 7th so I’ll speak to court closer to the time and push for the face to face. I’ve done a lot of reading, however having never stood on a court what are going to good questions to ask the claimant?0

100% agree. It would have to be a 3 way conversation with all parties hearing what the other is saying. It would not be fair for a judge to listen to one party and then telling the other what was said.
