    If anything, I'm inclined to counter claim for the amount of time they've wasted,

    Astonishingly that is not an option.  If they take you to court and lose you can ask for "unreasonable behaviour" costs (CPR 27.12 (2)(g)   but  these are rarely awarded.  When all is done and dusted you can claim for harassment, breach of DPA, your time, etc., read this

    CM, I'm just filling in the form as per bargople's guide; on D3 I have to fill in any other witnesses or person(s) that can make a statement. In the case this does go to court, would I be able to kindly call on your services to speak at the hearing?

    Well, it looks like I need to ask for your help after all :/

    Received Notice of allocation to small claims track in Brighton County and family court on the 12th of august.
    Unless OPS don't pay their trail fee (which the court said they had received notice they would) it goes ahead - they have until; the 29th of July to pay.

    Is there anything else I need to do at this point, and would you be able to be there? Cheers!

    What is your deadline for documents? Has it already passed? Usually it is 14 days, but usually has gone out the window with corona!

    Go through the guide to court and make sure you have submitted everything needed, and on time.
    DQ, WS, Exhibits etcetera.

    If you have received the scammer's WS and exhibits, please post it if you haven't already. I haven't read back yet so apologies if this has already been done. Please post the scammer's alleged contract as well.

    Have you read the OPS thread where they were Royally thumped by C-m, and told they may be reported to the Attorney General?

  • Hey everybody, thanks for your kind responses. I'm going through the Court Guide now.
    My wife just mentioned she had a friend in the car at the time of the alleged offence, who she could call as a witness..not sure if its too late for that, as I would need to get that info over to OPS as well?

    Fruitcake, thank you for that link. I read through it and it is brutal! Might help my case as well as its so recent, and might make the judge take a closer look at their lease documents - I don't know if the June 2020 court dates for explanation have happened yet due to Covid, but be interested what the outcome was of that. I also can't imagine lawyers like Mayo Win Baxter looking kindly at their documents being falsified, if that is the case.
