I have searched Abuse of Process by beamerguy and am not having any joy....I have been through many posts now and am getting there with my first defence draft but it would seem that it would be useful to see this thread. Any pointers?
You must use Search this Forum (from the first page of the forum NOT from your own thread) and click on Advanced Search, enter beamerguy (note this is case sensitive) in User Name field, enter Abuse of Process in keyword(s) field, change radio button from Threads to Posts, hit Search now.

I sent the SAR to the DPO of Horizon last week but haven't written to Gladstones to inform them that I have requested the SAR as I believe I am too late for that. However, I've just been reading other posts in the hope that I'll get some clues on my defence and found the following advice from Coupon-Mad:

The only thing I now add to the advice about when sending a PPC a SAR by email, is that when you also email BW Legal, tell them you are 'seeking debt advice' which gets you the 30 days grace you need to get the SAR results back, before the court claim arrives.

Should I be emailing Gladstones to tell them that I am seeking debt advice?
Yes of course. Isn't that what you read?
  • Sorry. I appreciate that my questions might seem irritating to you all who know so much about the process. I'm doing my best to work it all out but don't want to make mistakes that might jeopardise my case. Apologies.
  • Are horizon POFA compliant these days?

if not they may not be keen on spending more money knowing they will lose if defending as keeper.

I don't know - is anyone else able to advise?

Also read the abuse of process thread by beamerguy ready for when you do your defence later on.

    .

I have now read up about abuse of process on the beamerguy thread. My Claim Form has £60 added on as court fee rather than a debt recovery fee.... does that mean that I can't use abuse of process as part of my defence?

Gladstones has run out of excuses

In the ABUSE OF PROCESS you will see these ...

Gladstones told by Judge .... added £60 NOT LAWFUL

GLADSTONES: .... The rep sent by Gladstones admitted to the judge that the fake add-ons WERE FALSE This is now what any case can turn on if the FALSE add-ons are applied

  • Great, thanks so much. OK so I'll add that to my defence - I've been working on it all weekend with all the help from the various threads and posts here. It's still work in progress but I will post on here for any comments (it's bound to need amending!) soon.

I just noticed, they are claiming £700

    Court fees for this amount
    £500.01 to £1,000 £60 online fee

What is the breakdown of their claim before court fees

Amount claimed is over £600 - (4 x £70 plus statutory interest of around £60) then a court fee of £60 and Legal representative's costs of £70.
  • Of course I am actually in receipt of the Claim Form so does that mean it's too late to email Gladstones to tell them that I am seeking debt advice?
