    I attach a copy of the claim form as proof of the claim.
    You are attaching that to prove that you are the Subject - as in Subject Access Request - and are entitled to the data requested.

    So perhaps that sentence should be something like:
    I attach a copy of the claim form to confirm my identity.

    When a poster mentions a thread by someone, all you need to do is look up that member, in this case it's basher52, and read his thread by clicking on his username (or his posting stats on his 'profile').

    All members are in the members list, under the COMMUNITY tab. Top of every page.

  • I have now sent my SAR by email to the DPO at Horizon and am now in the process of writing to Gladstones to inform them of this as advised on the Newbie post. It says there that the letter to Gladstones should be sent by email .... I presume that it's OK to use their general email address ([EMAIL="enquiries@gladstonessolicitors.co.uk"]enquiries@gladstonessolicitors.co.uk[/EMAIL]) and that it should be addressed to the Claimant's Legal Representative as appears on the Claim Form?

    Writing to Gladstone's is at LBC stage , not court stage , now that a court claim has been issued they won't put it on hold

    In simple terms , I have no idea why you would email Gladstone's

    I would get on with my defence if you are at that stage , so as coupon mad told you , find and adapt the defence from the thread by basher52
  • OK, thanks. I was just going through the stages that are given on the Newbies forum... obviously missed that the Gladstones letter needs to be at LBC stage.


    I am planning to talk to the store manager at Sainsburys again - I've seen on another thread that it's worth stressing to them that they don't want to lose my business etc and I will also talk to the manager at the gym as suggested above. I talked to them briefly today and they apparently have someone who helps specifically with parking issues which sounds positive.


    Is it OK to put in lots of different defence angles - for example not knowing who the driver was on each occasion as well as poor signage (which of course may be different now) in addition to the very helpful facts given by coupon-mad on a previous post or is it best to stick to one angle?


    Worried that without any documentation other than the Claim Form it's difficult to prove and I may not have the photographs before I need to submit my defence.


    It's also worth mentioning that I am quite often in the car park on two or three occasions in a day and sometimes when driving in I have noticed that the camera on entry has not flashed up my number plate so I don't know if it's been recorded. I know one other person who was issued a PCN based on when they drove in on the first time and left at the last time ignoring the other exit and entries that they had made in between. Their fine was cancelled.

    You will not "prove" anything in a defence.
    The newbies thread is clear on this.,
    Your defence is SIMPLY a written list of your arguments as to why you are not liable for the amount claimed. Nothing moer.
    Evidence comes when you write your WS and associated exhibits are included.
  • I sent the SAR to the DPO of Horizon last week but haven't written to Gladstones to inform them that I have requested the SAR as I believe I am too late for that. However, I've just been reading other posts in the hope that I'll get some clues on my defence and found the following advice from Coupon-Mad:

    The only thing I now add to the advice about when sending a PPC a SAR by email, is that when you also email BW Legal, tell them you are 'seeking debt advice' which gets you the 30 days grace you need to get the SAR results back, before the court claim arrives.

    Should I be emailing Gladstones to tell them that I am seeking debt advice?
  • I have searched Abuse of Process by beamerguy and am not having any joy....I have been through many posts now and am getting there with my first defence draft but it would seem that it would be useful to see this thread. Any pointers?

    Are horizon POFA compliant these days?

    if not they may not be keen on spending more money knowing they will lose if defending as keeper.
