    I cant go back to the car boot because its hundreds of miles with no guarantee the seller would be there.


    Well it's your only hope. It's not Apple's fault, it's yours (and maybe the sellers).

    Someone died in a road traffic accident and the person killed had all their family photos on their iphone and they couldn't be retrieved due to it being activation locked by the person that died


    Take something from this. Back up anything that's precious. Do not carry it all round in a tiny device that you could lose it in, literally, in a drop.

    If I die, I definitely don’t want my family going through my phone, and especially not my photos! The ones that are for “sharing because of sentimental reasons” have already been shared :o;)

    It’s not over the top, it’s there to stop people getting into someone’s phone without their consent if the phone gets stolen or lost and is found by someone who then wants to use it. It just so happens that in this case it has bitten you in the backside because you didn’t make sure it was unlocked before you handed your cash over and didn’t make sure you had contact details in case there were any problems afterwards. A hard lesson for the future.

    Really? Sorry to say you didn’t check the value of the phone, even in fully working condition it is worthless. An iPhone SE (2 generations newer and the same size as a 5) came out in spring 2016 and has a trade-in value of only £30.

    Not worthless but definitely worth a lot less than allegedly paid by the OP.

    All of which leads to the conclusion that they stumbled into it blindly (their own fault) and now want divine intervention to change the facts of life.
