OP - could you put an ad in the local paper where you bought it, asking if the person who sold an iPhone at *** car boot sale on *** date could please get in touch. Apple has always been quite uncompetitive with trade in pricing.

OP you CAN get the activation lock removed, but you'd need to take it to a mobile phone shop that has the correct software, but it could have its hardware wiped and then reinstalled which would render the activation lock wiped.
Secondly, you will be able to update to iOS on older phones from later this year, although that's only from iphone 6 or above.
Think some more research should be made before posting by some.0 -

No, you can't. The activation lock procedure is stored on the Apple servers, you can format the phone till the cows come home and it'll still ask for the previous details when trying to activate.====0 -
