    Bit painful to do two hardcopies (one for the claimant, one for the court), and then arrange posting by recorded delivery, though I will obviously do it if there is no other way.
    Don't post anything recorded/signed for delivery because if the recipient refuses to accept it, they have absolute proof of non delivery - not what you want!  Send it by e-mail, inline with the advice in the NEWBIE sticky.  If you look you will also find the e-mail address - the same address where you sent your defence!
    Thanks, got it! I did read the Newbies thread again before posting my question, but the info I was after was under the thread on the new template defence, which I thought I was done and dusted with. Just saying, as I try not to ask stupid questions on here :-)
  • There will be a hearing on this case fairly soon, and I am currently working on the witness statement. I am a bit disappointed it didn't get struck out on the abuse of process arguments to be honest!

    That's changed in the period you seem to have been away from the forum. Water moves fast under many bridges here.

    It hasn't been to court yet, so that was unlikely.  If you read other threads, apart from your own you will/might have come across an appeal against the AoP argument known as the Semark-Jullien case.  If you go there and read the new defence template, it will explain it.  You can also search for those words in the Advanced Search facility.  The defence using AoP was never a defence in its own right but an attempt to limit the cost to you if you lost.

    If you don't know why these are no longer struck out for that reason (had you been keeping up with the forum over the Summer you'd know that).  Read the example witness statement to understand which appeal stopped the strikings out but didn't stop the argument against the added fake costs.

    I have not had sight of anything new including any witness statement from the claimant yet - I assume like me they'll probably submit it right near the deadline, so I probably won't be able to adapt my own witness statement in time. However, I can make verbal arguments at the hearing on them, I guess.
    Thanks for the recent comments on the various updates - indeed, it seems the sands shift all the time on this stuff.

    There are two icons on the response box header, one is for images one is for files, although sometimes they work for me and sometimes not, never yet worked out why!
