    The first time i tried, i used the insert image option. That Failed. The second time i tried i just pasted in the dropbox link, then i changed it by adding ********* at the front. Then i changed it by doing as Redx suggested and i changed the HTTP to HXXP, and that didn't work either.

    Ok. Well i was going to try and find the right person within the NHS trust and go directly to them.

    So my current plan, is to chase PALS and NHS Trust. Also to write to my MP and then send CPP an Acknowledgement of the LBCCC basically saying i deny i entered into a contract and that i will robustly defend this in court. And i'll also send them an SAR

    They are only claiming the £100. And it looks like they are using their in house legal department.

    I too have the impression that we don't see a lot of positive feedback about PALS complaints.

    But complaining is an art so give it your very best shot. I wouldn't emphasise the fact that occupants of car may have underestimated the amount of time spent at the hospital. That's really not the point from a complaints angle.

    What is very relevant is that complying with the PPC's terms and conditions was absurdly difficult. People do not attend hospital appointments in order to spend hours in the car park striving to understand broken or purposefully obtuse payment methods. Yet some try very hard indeed to do so and still get a PCN. This is entrapment, it's exploitative. Give it to them with both barrels, channelling the rage and tempering it with icy politeness.

    Make sure the complaint is well-structured and clear too - if PALS are over-burdened (they may well be!) - clarity may make your complaint stand out and it therefore it could be the one complaint they take a blind bit of notice of that day. Sad but true I think.

    As Misty says, complaining is an art. Be polite, but be robust and relentless. Seize upon their slightest error and exploit it, question everything.

    Have you complained to your MP yet about this unregulated scam? Have you complained to Boris as well since he said he is going to sort out this sort of thing?

    You need to be hammering both of them as well as the hospital trust/management/PALS.

    As for the advice in the NEWBIES being from 2013, it isn't, and it actually tells this and tells you to check when it was last edited.
    It was 2018 but is actually being updated this week. Some of the legal stuff is out of date though but it should all be correct within a week or so.

    The guide to court written by bargepole in post 2 of the NEWBIES tells you how to deal with a court case from LBC to the court date itself. Apart from an incorrectly spelled word, I believe it is correct and certainly suitable for you to use now, but may have a few adjustments in the near future so keep going back to the version in the NEWBIES each time you use it to ensure you pick up any amendments.

    If you have a claim as opposed to a LBC, then start by doing the AoS stating you are going to defend, but do not put anything in the defence box, not even a full stop.

    Please quote the issue date on the claim, and tell us the date you do the AoS. KeithP, one of the regulars will then tell you some important dates to note in your diary.

    Apologies, i wasn't specifically talking about the newbies thread. I'd found a thread by a retired solicitor talking about the LBCCC and the pre-action protocol. It was until i'd got several pages into that thread that i started to see warning posts saying that it was from 2013.

    I find the newbies thread excellent, and now my panic levels have subsided a little bit, i'm more able to start digesting this excellent resource.

    Thanks for letting me know about the updates this week. i think i will be reading this daily for the forseeable future.

    It is just at the Letter Before Count Claim stage at the moment
  • Ok, its a bit of a flaff but the only way i could get these links in is to delete the first part of them. If you prefix each of these links with:

    h t t p s : / / x x x . d r o p b o x . c o m
    (deleteing the spaces and obvioulsy replacing the xxx with www)

    Don't read the lazydaisy thread or posts , other than as background information , because a lot has changed since 2013

    If you are going to read posts by legally qualified people , read those by loc123 , Johnnersh and Bargepole

    The added £60 abuse of process usually happens at debt collector stage or in court claims , but has nothing to do with the core principle , the PCN

    As for complaining , if you don't ask , you don't get , plus judges like to see action and a paper trail , plus if MP s get enough complaints they may get the Mhclg to get on with the changes in a law passed almost 12 months ago by the government and has received royal assent in early 2019

    There really is no valid reason for the delays
