Hi All,
If anyone is so kind i would desperately need advice. I've been reading thread after thread after thread, some were from 2013 and then it seems that info is no longer relevant. Partly due to the stress and panic i've got myself confused on what right and what i need to do. Some calm clarity would be gratefully recieved.
Firstly, i found these forums too late. I appealed to CPP, REJECTED and i appealed to POPLA (again, all before i found these forums) and again REJECTED.
I am just Sooooooo seathing MAD....RAGING infact.
Its a VNPR car park. I attended the Hospital to take my son to Eye A&E, so i wasn't there for an appointment. We had no waiting time, straight into a room and were seen by a nurse and a Dr. I'd never experienced such a quick visit to A&E before in my life.
I cam out, went to the pay machine and entered my vehicle registration number. Machine said it didn't find it. So i entered it again. Still couldn't find it. There was then an option on screen if your VRN wasn't found. I selected this and it asked me to pay the amount for the period of time i thought i'd been parked. I selected 1 Hour (i honestly didn't think i'd been that long), paid for that, took my receipt and left.
I got the PCN from CPP. I Appealed, saying look i did pay, and here is the reciept. Rejected. Went to POPLA and i said look here is the receipt. But CPP provide the ANPR images and timestamps which show i was actually there for a total of 1H 45m. So now they are claiming i didn't pay enough.
I stated that i had no frame of reference from which to base how long i'd been there, that the machine couldn't find my VRN and that i was invited to GUESS how long i'd been there. But POPLA Rejected this. WHAT A JOKE!!!
How can they invite me to Guess and then PENALISE me for guessing wrong and how can they get away with that. The thing that winds me up most is that this is a Hospital. If i'm finding this stressful then what the HELL is this company doing to Older and emotionally unstable people.
I have now recieved a LBCCC and i'm just confused how to respond. I've drafted a letter for the Subject Access Request (SAR) but i know need to Acknowledge the LBCCC. But i don't want to screw this up like i did with the appeals.
Do i just send a basic letter, to say i've recieved it etc. The LBCCC response stuff i read was from 2013 and later posts warned not to rely on legal advice from 2013. Most other threads i've found about CPP and Coventry Hospital were at the POPLA stage, so they didn't really help me.
I'm almost at the stage of just paying the £100 to stop the stress, but i just don't want to let these Bar Stewards get away with this.

Have they fully complied? Have you complained to the Trust? It might also be worth complaining to your local Trading Standards Department. and your MP. How much are they asking for? If they have added an unlawful £60 read this

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

you must get onto the hospital, look at the nhs partying principles linked to above, add use that as a reference for your complaint.From the Plain Language Commission:

I did look at the NHS Parking principles. Wasn’t sure how this would help or how enforceable this is, beyond a complaint through PALS. But every thread I’ve read about people going to PALS says that they are completely useless and basically not interested.
From those principles though, the only bit I think is relevant is in the Contracted out Car Parks section, which states:
‘Reasonable’ implementation of additional charges practice might include additional charges for people who do not have legitimate reasons for parking (eg commuters), or who persistently flout parking regulations (eg blocking entrances). A period of grace should normally be applied before a parking charge notice is issued
I had legitimate reasons to Park. I feel that it is entirely unreasonable to apply additional charges. And even more unreasonable to make me guess how long I’d parked and penalise me for guessing wrong, especially when there was every expectation that the payment system would tell me how long i had been their and how much i had to pay. After all, thats fundamentally how the ANPR system is meant to work. And i find it even more unreasonable that i am being penalised due to a failure of their technology
I will look at SRA complaint. Just not sure how they have breached their principles yet.
The PARKING CHARGE was/is £100. So there is no issue of Abuse of Process.
I fully intend to write to my MP and to copy CPP in on that letter.
The LBCC was dated the 8th Jan 2020. So in the first instance I am keen to respond to this. I have drafted an SAR which requests the following:
- ALL photos taken,
- all letters/emails sent and received, including any appeal correspondence,
- All information provided to POPLA with regard to POPLA Ref: xxxxxxxxxx,
- A full copy of the Parking Charge Notice,
- Payment machine records for the date and period identified on the Parking Charge Notice, including any logs of unrecognised VRNs entered within this period.
- Any other information you hold about myself.
Does that seem ok, have I missed anything critical? I’ve used a standard template for the main body of the letter.
My immediate concern is how to respond to the LBCCC, how to write the Acknowledgement letter. I’m not sure if they have entirely conformed with the Pre-Action Protocol, as they state. But I don’t fully understand the Pre-Action Protocol. Some of the Advice I read on this is from 2013, and would appear to be out of date.
So I’m just not clear what I need to say in the Acknowledgement.
After that, I’m not certain on what grounds my defence would be, other than these parasitic vultures are the skid marks on the Y fronts of humanity.0 -

what you do is host your pictures on imgur and add a dead url to your post , by changing http to hxxp in the url from imgur
its that simple, post a dead link to a file hosting site, so use imgur for pictures and dropbox for documents etc1 -
I knew i couldn't upload the pics. So i tried to link them to a dropbox account. I also tried to disguise the http by putting ******* infront of it. But that didn't work. I just tried hxxp instead and that didn't work either.
