    Actually it is not quite as simple as that.

    If the loss suffered by the business in the event of a cancellation is not as much as the deposit then in many circumstances the client is entitled to a refund of some of the money.

    Equally, if the business loses more than the deposit, following a cancellation, then they can often claim more more money from the client.

    In both cases, like most civil claims, the business has a duty to keep their losses as low as is reasonably possible. What they can't do is deliberately run the client up as big a bill as possible.

    Actually it is not quite as simple as that.
    Indeed, I was over-simplifying it for the sake of brevity. I think the SIL paid more than just a deposit anyway - which I think was 25% and she had made 2 such payments, totalling 50%. So none of it is that simple - as the amount of posting indicates.

    Hopefully, OP is hot footing it down to the shop right now to grab that dress before something else changes.

    Maybe pay the unexpected good fortune forward as well and try and resolve the family fallout before the wedding.
  • Quick update on the dress situation,
    Got my wedding dress and veil this morning..
    Bridemaids wedding are still with supplier and have not been released.
    Wedding shop has told me that there supplier is in the Middle East and are being delivered in the next shipment. I did give the shop another 200pound today even thou I did not have 2.
    I do think the shop has a cash flow issue as she mentioned that it was her accountant who told her to hold my wedding dress until the remaining 565 pound was paid of bridemaids dresses.. when in said she could resell the bridemaids on as she hasn’t loss anything in them at all as SIL has actually paid more than the 50% of dresses. She again said her accountant would not allow this to happen.. And her hands were tied.
    I don’t think she has paid the supplier the full amount as she has told me 3 different stories.
    She didn’t have the dresses
    She did have the dresses
    Now there I. The east coast waiting to be shipped.. all so confusing..
    but main thing is I got my wedding dress and veil and I couldn’t be more happy ��

    As someone who once ran a business, why should a retailer have to attempt to sell on a set of items they wouldn't normally hold in stock. You make it sound so easy, it's not that simple.

    No more confusing than your convoluted family situation and all the problems that have arisen as a result, none of which was the fault of the retailer.

    It is not her accountant's place to "allow" or not allow anything! She pays him to do a job and give advice.

    All that matters in this is that she operates within the law and in accordance with any lawful contract agreed between you. The rest is just hot air!

    You have apparently now got your dress, which is great. Personally I would take proper advice about what, if anything, you still owe her. If that is less than any remaining direct debits then I would cancel them and send a cheque in full and final settlement of any outstanding balance.

    With the greatest possible respect, some of what you have posted on here as the "advice" of Trading Standards or the solicitor you said you spoke to seems at odds with the legal position (as well as can be established from this somewhat confusing thread). Do please make sure that you get any advice from a proper source, that they have all the facts and that you fully understand what they have told you.

    How you sort out the family tangle with the estranged sister in law heaven only knows!

    I have asked for someone to explain how I post photos on this and I can show the emails and messages.. Regradless what you think is truth or not. I’ve no reason to hold anything bk. All i was doing was relaying bk what I was being advised and told to do.. to be fair and could not care less as I have my dress and veil which my father paid for.. again for the 10,000th time the bridemaids dresses are nothing to do with me. There in my SIL name..
    so anything from here on is hot air to me, nothing to do with me and whatever you want to write or say now is irrelevant to me as I only wanted advice about my wedding dress and I’ve got it now..
