Bridemaid dress cancellation

I ordered and paid my wedding dress in full
After I paid in full I ordered bridemaids dresses and paid deposit on them. 600..
I had to cancel the bridemaids dresses as there was a big fall out with my bridemaid who was paying for them.
The wedding shop I ordered them from won’t release my wedding dress now even thou it was a different booking and paid in full

They said they can keep my wedding dress until the other balance is paid of the bridemaids dresses .. even thou they were ordered 8 months apart and 2 separte orders.
I have my receipt to say wedding dress was paid in ful.. please tell me the wedding dress shop can’t keep my wedding from me..

    Wedding dress was order August and paid in full on 27th April (2295) my dad paid for as my wedding gift..

    Bridemaids were measured on April 27th but full deposit wasn’t completed paid until may 24th and that is when they were ordered.

    Can they keep my wedding dress from me if they are 2 completely different orders

    You are correct, they can’t withhold your dress if it’s paid in full, as that’s your contract.
    However, you can’t pull out of the contract on the bridesmaid dresses assuming they are unique items made or customised to order.

    You can start legal action over your wedding dress, but that would likely lead to them doing the same over the bridesmaids dresses.

    It sounds a little like you want to force them to stick to contract but not do the same yourself. Unless I misunderstand.

    Hi malkie,
    No I have told the dress shop that I would absolutely continue to pay the rest of the balance on the bridemaid dresses. I just said I could not pay them in full as they want full payment before releasing my wedding dress. Even thou both bookings are separate, and ordered 8 months apart. they said as a shop they are doing nothing wrong. I also said I would set up a payment plan to pay of balance but again they were not happy and keep pushing for full balance. I know they can not hold my wedding dress on me but as it’s so close to wedding and my dress is due to be altered next week with dress maker. I was wondering what is my best opinion .. and how can I make them give me my dress..

    Since time is of the essence, borrow the money, pay them in full and sort it out later. There is no other action that is going to release the dress by next week.

    Hi atm I can’t just borrow the 650 they are looking as it’s straight after Xmas.. I told them I would put a payment plan in place with my bank to take the money out but they won’t have it.. as I’m not breaking my contract as I’m still willing to pay the bridemaids dresses. I can’t see how they can break there contract by not releasing my wedding dress as it’s paid in full even before the bridemaids were ordered. And there’s nothing in any contracts to say tht they can hold my wedding dress until other balance is paid .

    If it's so close to the wedding then you are not in a strong position. Any legal action will take a few weeks.

    Your dress is their leverage.

    Understandably they are not confident you will pay up for the other order having presumably failed to do so by the due date already.


    With the timescales involved, I doubt you can do anything other than pay up by borrowing elsewhere if need be. How much are we talking and why didn't you still need at least some of the bridesmaids' dresses?

    Yeah my wedding is in April. But dress maker needs it or alterations on feb 1st .. I am ringing solicitor and consumer rights today for some advice and I’ll go from there

    Not ideal but can you not use the shop instead of a dressmaker for alterations (paying as you go) which presumably would give you longer to pay for the other dresses?

    Hi Warby,
    I was speaking to the shop in November and explained everything then to mine. I asked to put a payment plan in place..
    my sister in law was paying for the dresses as my gift, but we had a fall out and she told me she had cancelled the bridemaids dresses on me. As she was the person paying for them. She made all payments through her online banking.. I went ahead and ordered new dresses.
    When I spoke to the shop they told me dresses couldn’t not be cancelled and as my sister in law wasn’t making the rest of balance up, I had to because I’m the bride and my name was on the form sheet. so I said I would put a payment plan in place to pay the remainder of the balance. They told me there head office wouldn’t allow that to happen and that they would send me out a letter. So I was waiting on said letter from them but I never received one. I rang the shop and left message to collect my wedding dress .. ( both separate booking, 8 months apart.) and they are saying they aren’t giving me it. they saying I’m in a contract with them. Which I am and I’m willing to pay balance..
    I’m sister in law paid 680, which was over half the balance so there’s 600 remaining on them
