    This has been asked before but not answered:

    Why, when the SIL ‘cancelled/said I’m not paying anymore’ did you not go to the shop where you had previously ordered the bridesmaid dresses? You (OP) filled in the forms as you have stated they are in your name, she just snuck back and started paying. You had clearly wanted those dresses, so why when faced with this ‘cancellation’ did you go and buy totally new dresses without ever contacting the previous place.

    You also haven’t answered when the dresses were due to you, due to be paid up and when they were ‘cancelled’.

    Hi Katrina,
    I stated in an earlier post that I was interested in the dresses but I did not put a deposit down on dresses. I have this proof and all recipes from SIL to confirm this. Dresses were measured up on the 27th April and the dress shop put my name on top of the form with the girls measurements.
    I left the shop and said when I had the 600 deposit I would ring them bk and make payment over phone.

    2 days later which was the 29th April my SIL made a payment of 300 to the dress shop without my knowledge. Dresses stil were not ordered at this stage.
    SIL then made another 2 payments of 150 on the 21st may and 24th may ( this was when dresses were ordered)

    All correspondence were between the dress shop and my SIL not me. Then there was a huge famiky fall out.
    My sister in law called and told me she cancelled the dress order and that I wouldn’t be reviewing them. So I went ahead and ordered different dresses online . 2 weeks later I got a call from the dress shop to say payment was due and that my SIL had rang to cancel dresses and wasn’t paying the remainder of bill and I was liable.
    I explained all to dress shop. Asked them could I set up a payment plan through my bank to pay of the balance as I didnt have the full amount and they said no they could not accept my offer. They then told me they would be sending me out a letter to say I was liable and what the next stage would be for making payment.. this was in November and I have never received said letter.
    So I took from that, that they were keeping deposit and the matter was going no forward.
    Until I rang to colect my wedding dress as it was a different order and paid in full and they won’t release it. I am still willing to pay the full amount by direct debit but again as I’ve stated they won’t accept that ..

    I can send all receipts for proof to this with all dates and proof of payments etc from SIL ..

    You have a fair chance of winning but there again so does the shop. As said before this isn't cut and dried at all.

    What you do is a decision only you can make but you have a few options. Take a gamble and take the shop to court. It's a huge risk though and there is a massive likelihood that any case wouldn't be heard in time.

    Raise the money and sort it out after with the shop.

    I'm not sure (you may have said) but did you put the offer of paying in instalments in writing? If not and you are prepared to pay like this then it's more powerful an offer if it's written down. It's much easier for them to enforce it. You can also invite a counter proposal.

    Sue your sister in law. You would appear to have a reasonable case against her for breach of promise. Again no guarantees but it has legs.

    Let us know what you chose to do. Sadly these are decisions only you can make.

    I see a number of further issues not already covered - if the OP/bride pays the balance of the bridesmaid dresses - who owns them - as the SIL has paid just over half their cost and the bride just under half. If paid for in full, the shop must then have to relinquish them, but who to - who owns them? The bride now has alternative dresses from elsewhere - so presumably doesn't now need the original frocks, but can't sell them as she doesn't fully own them. Bit of a minefield.

    Similar with the bridal gown and veil - if it has been paid for in full - if the shop decide to keep hold of them both - is the bride entitled to a refund - surely the shop can't retain both the gown and full payment? The owner is relying on a bride being desperate enough to want to get at her dream gown and holding it to ransom - if it were a TV set or piece of furniture, the customer would probably tell them to get lost.

    If I were the shop owner, I think I'd let the bride have her gown and draw a line under the bridesmaid dresses to close the matter off and be rid of the problem - she's had a significant deposit, which must cover most of any financial loss on the bridesmaids gowns - even if she has to pay some more to the designer, as stated, there must still be an opportunity to get them into her possession and re-sell them to cover any remaining loss.

    Seems like no party can be a winner in this situation and I'm surprised the shop don't want this issue dealt with promptly and discreetly - if my quick mental tot up is right, the shop is only out of pocket at present by around 15% of the total of both orders - hardly seems enough to risk reputation and future custom over, when it can possibly be recouped by less unpleasant means. I suspect the shop has a cashflow issue, as already mentioned.

    Boojewels I agree with everything you have said.. I am in a very difficult situation and it’s causing me a lot of stress.. I have had legal advice and trading standards are investigating this matter as they have said the shop is breaking a criminal law by not releaseing my wedding dress. The only thing the shop really have is time.. I don’t have the time as my dress needs to go to alterations by feb 1st
    There is indeed the matter of who owes the bridemaids dresses as no payments have been made from myself on them .. I only have screenshots of the receipts but it’s my SIL who has all originals from the shop..

    I have all my receipts from wedding dress and veil..
