e2save "price match" claim form

    I have a phone from E2Save which I got on an 18 month contract in December 2006. I am with orange and pay £35 a month for 500 mins and 500 texts. I get free broadband internet from orange and £49 cash back every three months (from May 2007) from E2Save, which I've never had problems with claiming. I am really pleased with this contract and want to continue when my contract expires in May 2008. However, I do want to upgrade my phone soon. Does anyone know if I would be better off waiting till May 2008 and getting a new contract with E2Save (and a new phone and cashback) than upgrading with Orange in February and then not getting the cashback offer on my new 18 month contract? Sorry if this is a stupid question but I don't understand!

    That's not actually correct. The way they are working goes against the actual t&c. They are (for now until they change their mind again) allowing a 30 day slot which bears no relation whatever to the bill date. Thus, (for example) if your fifth bill is dated 10 days after their start of their 30 day window window and they don't get it until 25 days after it's date they will decline all claims. Every individual's dates are different now. Many will be ok and/or lucky - but many will fall foul of the way they now do things.

    I understand the 30 day window is from 120 days from purchasing the phone, up until 30 days after this date.

    Apart from this, do you agree with what was sent previously ?

    Not sure what you mean by "sent". Basically, you can use the November bill on the right dates as long as they stick with the way they are arbirarily doing things. The december bill could give you the opportunity to meet both main sets of t&c but with limited time to get it there and having to wait a month longer for the cheque (assuming they pay). If you are late with the December bill you can fall back on the courts, since they are ignoring the legal t&c.

    Everyone should take note; they also keep changing the t&c as they go along to try to cover up the mess. It is basic practice to copy everything at the time of purchase.

    Sorry, that should have been 'said previously' not 'sent' - as in everything else that was discussed in the previous posts.

    My only concern was that the T&C's actually mention to send the bill showing you have been connected for 120 days - the bill dated 20th November, wouldn't show 120 days connection, but 18 days short of this ??

    I know it is confusing, and that is the main problem.

    You mention that it is possible to both stick to the legal T&C's, and also to those they are telling people to do.

    Based on this, would sending my November 20th Bill, after 8th Dec (120 days), to arrive before 28 days after 20th November be legally correct (taking into account I purchased the phone on 10th August on their price match deal) ??

    I just want to be sure that if they reject the claim, I have done my part 100% correctly.

    It would meet the way they are doing it - but not the legal t&c. I'd be fairly certain they'd pay - but can't trust them as you used to be able to. If they don't honour the November bill and you know it in time you can still send the December one and claim. They MIGHT say you can't because you claimed too early but IF they did (which I doubt) it would be rubbish and you would have met the legal t&c. This all dates back to the numerous changes (for the worse) this company has made in the last 8 months I'm afraid. It's quite complicated and some choices aren't straightforward. However, I might go with that plan in your situation. Two weeks after they received the November bill, call or email the cashback team and ask if the cheque has been raised. Don't draw the rest to their attention. If it hasn't and you're running out of their claim window, send the December bill. Every person on these deals is in a completely different situation; all mine are set up in a different way with all this in mind from the start. However, given your particular circumstances that's what I would probably do.

    Unfortunately my terms state if an incorrect claim is made, I forfeit all remaining cashback claims :(

    There are some things I won't share - otherwise they would be thwarted. However, if you look closely at the full t&c I think you'll find the "forfeit" is for late or incorrect claims - not early ones. Although they tried it on already with people who did get it wrong and claimed early those who didn't accept that got their claims reinstated (although the company said it was a "gesture of goodwill" it was, in fact, something they had absolutely no choice in and zero goodwill was given).
