    It should be easy enough to explain that you didn't get the form and why. What then will the claimant say about service ? My guess would be, if they dispute it, that it's merely going to be the case that they'll say we got it from the DVLA and that they made zero further effort.

    I think that should be enough but i'm aware that some judges think differently to other judges so it may not be enough for all judges. It's still a parking matter and i'd fancy my chances in Southampton were better than my chances in Manchester, for example.

    I haven't heard back so I will submit the form now so that I can get it in for January. I emailed them on Sunday.

    With respect to the fee for the set aside, when do I pay that? And how? Does not seem to be clear immediately.

    Is this the right move now or should I still wait?

    You send a cheque or postal order with the N244, witness statement & draft order.

    Or, you phone the CCBC and pay it by card, a couple of days after posting your form.

    Or, you grab an early chance to familiarise yourself with what your local court looks like, how easy it is to park nearby, and which door to go in/what the security area looks like, by taking your form and statements firmly stapled together) to your LOCAL court in person and paying there.

    But getting this in dated January looks a lot better then Feb, somehow!

    There is no link to submit this online.

    Why not email it and your WS and 'draft order' to the CCBCAQ email address* then ring them on Monday and ask to pay by card to match that email...and they will tell you if they want a hard copy posted too.

    If none of them suit you, make enquiries with either you local County Court or the County Court Business Centre.

    I think Google even has a search facility.
