    In Scotland:

    If the creditor waits too long, the debt will become extinguished. Once a debt is extinguished, the law says it no longer exists so there’s nothing more the creditor can do collect it.

    Thus, once it is time-barred then it no longer exists (in Scotland). :)
  • Same - received a notice today from DCBL (dated 12/12/2019) on behalf of Highview Parking with a contravention date of 19/12/2014. An amount of £70 + VAT has been slapped on by DCBL as an admin charge. I have/will not reply to any of this unless advice here changes. It seems the 5 year time window for the party to take action has expired anyway.

    People should all report DCBLegal (if they are sending these letters) to the SRA.

    I ignored them and they have sent another letter

    Pre enforcement letter. Stating they are going to recommend to their client to commencement of legal recovery action against me.

    DCBL are getting very confused with their bad terminology and they probably think this is related to their soap opera on TV ... "Can't pay we'll take it away"

    Even school children know that nothing can be enforced until it goes to court and they win, and you don't pay. That is enforcement
    Pre enforcement would indicate that they are about to enforce ...... It's not even been to court yet ????
    DCBL are heading for court spankings anyway regarding the fake £70 plus VAT add-on.

    You should send a copy of that letter to the SRA as a complaint

    In the meantime you should respond to DCBL
    1: On what legal authority do they have to add £70 plus VAT
    to the claim
    2: Did their client instruct them to add this amount

    Of course, we already know the answers but let's see what DCBL say as it can be shown in court

    Co-incidently my wife also got the same letter. We are just filing it, if we get a further letter or court summons we will write and say it is out of time and please stop sending what seem like letters sent to intimidate.

    I have contacted SRA and will contact trading standards on Monday morning. I have mentioned to SRA that it is statued barred . Dates of when it happened is on letter
