So what would I do if they appear at my door? I have sent a form on their website anonymous saying that this claim is not valid and is out of date and to remove all my information from their database and if anyone turns up at my door i will charge them as its fully owned land.

Can I call the police on them?

    Paul
Nobody will turn up at your door without a court order , same as on the TV programme

If they did call , without a court order , you would tell them to leave , if they fail to depart you call the police

The court order is crucial , so stop panicking and stop making wild assumptions

You have told them to erase your data as the alleged debt is disputed

You disregard (not ignore) the debt collector letters

If a court claim letter or formal LoC arrives , come back for guidance , but I fully expect it to time out due to statutory limits (5 years in Scotland , 6 years in England)

FWIIW, I have used DCBL to collect a debt following a CCJ. I found them very efficient and would recommend them highly.

  • Sorry .. one more question. It has time out by over a year so can i expect a court order? or most likely scare mongering letters?

If you are living in Scotland and it happened in Scotland , then you are correct , so point that out , that it is statute barred after 5 years in Scotland and they should know this and so should seek legal advice and destroy your data under the GDPR

Bear in mind the alleged debt never goes away , just the ability to enforce it using the sheriff's office in Scotland , meaning they should write it off , so if it did arrive , your reply to the sheriff's office would point out there is no keeper liability in Scotland and it's statute barred after 5 years anyway

Send them packing, along with their cohorts - The Tooth Fairy, Father Christmas, Frosty the Snowman, The Easter Bunny and Puff the Magic Dragon.

    A fearsome bunch! :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Difference here Sir Deep that your debt was legal and you did not add on fake amounts

And as you say .... following a CCJ .... not before

It's not been to court so they CANNOT.

If they did, then yes call the police and get them removed for trespass ...... BUT, THEY WON'T

Jaff, you could write to the DPO of all parties involved and instruct them to erase your personal data as the alleged debt, which you deny, has been barred by statute for over a year.
After that you disregard anything and everything you get unless it is real court papers.

Report them to the ICO if they refuse or fail to erase your data. You must use the word in bold.

Does she need to pay or is the case the same as above?

She only needs to pay if a judge so orders. Have you not read the stickies? You are asking questions the answers to which are contained therein.

Are you seriously asking can they take a time barred debt to court? Do you not know what time barred means?

    Here is an explanation https://www.stepchange.org/debt-info/can-i-write-off-debt/statute-barred-debt.aspx

Scotland has its own specific section so don't get confused with the other bits.
