    You had 33 days from the 12 Feb having done the AOS more than 5 days later

    It appears that you did not file the defence within that period , so with a default judgment you should pay it within 30 days to stop it impacting your credit rating

    One of your options is shown clearly on the judgment form  - you can apply for a set-aside.  This will cost £255 unless you qualify for help with fees.  Option 2 is to pay the amount shown in order to prevent the CCJ from being entered on your credit file.  If you do decide to go for set-aside, you will need a very good reason for not submitting a defence.

    It’s my fault I know and am extremely gutted and angry at myself.  As I said I suffer from anxiety and work in the medical private sector and have been expected at work until they finally said we could stay at home. This has been dominating my mind. I don’t qualify for any benefits and would feel it’s unfair to pay cpm over £400 for parking in my own freehold space. How likely from any experience could I win this and reclaim the £255? I’m worried out of my mind and I am the only financial provider in my household. 
    This is also the second claim against me even though I thought they cannot keep sending multiple claim forms. Would anyone be able to help with a set aside ? I’d really like to do it today if possible. The stress of this is really getting to me along with the current situation we are all in. Would greatly appreciate any further help. Thankyou

    Here's how - DO NOT ring the parking firm up...and do not just pay them:
    There are more links for you to look at.  You will need a VERY good reason why you did not complete the AoS process on MCOL and submit a defence - maybe there was a technical error with the MCOL web site????
    You could also search the forum for posts by henrik777 as he specialises in set-aside help.
  • Thankyou I had a read of these before. Feel very down at my mistake, just haven’t been able to think straight . I will have a look for henrik777 and  have a go on the MCOL site . Iv had a clear credit Record and I’m incredibly upset at myself. 
     Can’t believe they have sent another letter before claim also . How can they keep sending me multiple claims ? The 2 are both for me on my name for both of “my” cars . They still haven’t sent me my sar. Very frustrating all for parking in my own freehold space. Sorry for the rant, just very down today

    Well, the default is pretty much your fault so it's going to be difficult to get any money you spend on a set aside returned.

    You could ask them to consent to a set aside but i can't see anything in it for them unless you agree to pay. As your credit rating would be the same whether you paid the CCJ now or managed to set it aside by consent and paying £100 more for the privilege, that appears a waste of time.

    You could apply to set aside but you're risking £255 to save £424.52. Best case scenario is that you manage to get the £255 reserved as costs in the case. Even with this it's always better to ask them if they'll consent, even if it appears unlikely, before making the full application.

    As long as they are acting on behalf of the claimant, yes.

    Write to the court and ask them to suspend all action on this, copy it to your MP. 


    You never know how far you can go until you go too far.

    please read carefully the advice being given ....... sadly you may struggle ......

    D_P_Dance advice should be considered.......

    you should all so consider contacting the papers saying how badly this effecting you in such uncertain times.

    How can companies be allowed to get away with such when people are stressed to the limit .... A paper article could just tip the balance in your favour ........ you never will know unless you try ....
