Court form received help requested

I'd really appreciate some help.

Last year cpm took over management of the car park where I live. I received multiple tickets for failing to display a permit. The reason for this were various- not recieving the permit, not knowing the system was live and not being happy that the permit shows an indication of where I libe thereby compromising my safety.

I received multiple letters from cpm and then from glad stones and back then th advice seemed to go towards ignoring the pcns.

I have today recieved a court letter from Northampton with just one date given for last year. They are asking for a total of £247 .

I do not agree with this and given I am parking outside my own house . The car park is managed by a management company who cannot do anything about thsee pcns.

Can anyone help?

    Have you received a Claim Form from the County Court Business Centre?

    If so, please tell us the Issue Date on that form.

    I tried repeatedly with them last year but with no success stating it all goes through cpm.

    With a Claim Issue Date of 9th December, you have until Monday 30th December to file an Acknowledgment of Service. If possible, do not file an AoS before 15th December, but otherwise there is nothing to be gained by delaying it. To file an AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having filed an AoS, you have until 4pm on Monday 13th January 2020 to file your Defence.

    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not, chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    The Management company contracted with the scammers. Of course the MA could have cancelled these - but not now.
    Last year cpm took over management of the car park where I live.
    Why did you let them, why did you agree to it? You could have opted out.

    Are you a leasehold owner or a tenant of a private landlord?

    Do you have an allocated space, or is it first come, first served, or a mix?

    Residents don't have to accept this derogation from grant.

  • I own my house and have car parking behind which is shared with other house and flat occupants. My own spots are allocated. We had repeated trouble with people parking in our spots after our main gates kept getting vandalised. The management company went ahead with this as they felt it was the best solution. I repeatedly stated I wasn’t happy getting fines due to parking in my own spot and wasn’t happy that not only did I feel the permit breached my security but also other non locals were still parking in my spot.

    I have expressed my anger frustration and reluctance with cpm being used as a parking company but the management company are just as bad and will not listen .

    We know, but by not rejecting the permit, they will argue you acquiesced.

    You didn't, and this is defendable, but it is best to INSIST that your allocated bay is not enforced at all and is excluded from the system. Then you can ask for permission to put up a lockable pole so you can control who parks there, instead of the scammer firm.

  • I have insisted on this many times with the management company who are worse than cpm. I will write to them again thankyou
  • I have submitted an aos today on mcol. I hope this means I have till a good while after Christmas to write my defence and can enjoy the Christmas period. Thankyou for all your help
